Hi Folks,

It has been a while since I've read and posted. Here is my update and questions. My fiance has been here now for 2 months on his K-1 visa. When he came through JFK he got his I-94 work authorization. Later he also got his SS card that is marked "valid for work only with DHS authorization." He hasn't been employed as of yet. We have been living together now for 2 months and we have worked through many communication issues and us being together for more then just a few days as well as his adjustment to the US. And we are still loving each other and our relationship has strengthened. So we are very excited and we picked out our wedding bands and will be getting married in 2 weeks. So now for the questions:

1 - We will be marrying in about 2 weeks which will be about 8 days before his visa/I-94 expires. He just found a local union in his area of experise is possibly interested in employing him. It will most likely happen after the I-94 is up. How do we go about extending the work permission?

2 - The SS# I believe is temporary - Yes? Is it good til he gets his green card?

3 - How does one go about getting DHS authorization for work? and what is DHS as I said I've been out of the loop and I've gone brain dead.

The only thing you can do is file AOS/EAD after your marriage. The EAD typically takes about 90 days for approval. Before that, once the I-94 expires, he'll have to wait for his EAD to continue working. DHS is Department of Homeland Security.

1) The temp EAD can not be extended. It is just that temp. As a K-1 once your temp EAD expires the way to have further DHS proof is by filing for AOS. At the time of filing you can choose to file for a EAD that would be valid for a year after approval (Generally takes 70-100 days to be approved) or just waiting for your AOS to be approved that can take from 2 months to 2 years. The employers are the ones responsible to prove to the government that they have verified that your husband is work authorized. So, if they don't care whether he is or not then technically he could work for them. Legally, for the employer it could be a big disaster.

2) The SSN is not temp. Once you have been assigned a SSN that remains with you always. Once your husband has his Green Card you can have the "With DHS Authorization...." wording removed.

3) DHS work authorization = EAD it comes in various forms but the stamp that your husband got upon entry was one work authorization. Another would come from an approved I-485 (AOS) or I-765 (EAD)

May 29, 2007... GREEN CARD ARRIVES.. and email from CRIS approval notice sent (Day 75)

Sept 25, 2008... Moved to the UK

Feb 24, 2009... Mailed I-751 to CSC from UK

December 30, 2009... Approval notice!!

Jan 9, 2010... 10 year GREEN CARD arrives.

May 31, 2012... Express Mailed N-400 application to the Nebraska Service Center for military spouses filing overseas

Jun 11, 2012... NOA date and Cheque cashed Day 11

Jun 28, 2012... Placed in line for interview scheduling Day 28

Jul 20, 2012... Email from USCIS London for info to schedule interview Day 50

Sep 1, 2012... Moved back to the USA

Sep 12, 2012... Email from USCIS London scheduled for interview/oath Sept 28th in the UK(will be day 120)

Nov 26, 2012... Had submitted change of addresses. Notification that I have again been scheduled for interview Day 179

Dec 1, 2012... Letter arrived Day 184 with new interview date Jan 4, 2013 (Will be day 218)
