My husband has a US green card (2 year) which expired in March of 2019. We applied to remove conditions using the I-751 form within the 90 day timeframe.

We received a notice saying that our form had been received and that we may receive a biometrics appointment. After a couple of months of not receiving anything we called to see if it was lost or if we didn't need biometrics at all. We were told biometrics were not needed and we received a notice stating that no biometrics were needed.

We then left for his home country to tie up a few loose ends (family, etc.). We've been here a couple months and will be here a few more months. We knew that we would most likely have to return to the US to do an interview.

However, we just received notice that he has a biometrics appointment schedule for a week from now. With current obligations, we cannot go. We also planned financially for only one trip back to the US during this time (we are not working at the moment as we help with family obligations).

The notice says that if we don't go to the appointment our case will be considered abandoned unless we reschedule. We have a few questions about this situation.

  1. If we reschedule, is it likely to be for a week later? A month? Several months? How long will rescheduling set us back?

  2. How many times can we reschedule if we can't make the next appointment?

  3. What is the usual timeframe between biometrics and interview for the green card extension?

  4. What happens if we can't make it back to the US before the year is up? Is he still a legal resident if there has been no official judgment made on his case?

Did you get an extension letter or an ADIT stamp in the passport before leaving the USA?

We did get the extension letter, for 18 months after the expiration, which puts us at September 2020. 

We will be returning around June of 2020, which puts us at less than a year outside the country so his residency should not be in danger.  (We were gone once for 10 months with no problems).

How is he maintaining his Permanent Residency?

10 months? Wow. They advise immigrants not to stay out longer than 6months. Maybe you were lucky then maybe not this time around given our country's immigration is running now.
