I am keeping the email sent to me by my benefits department. It seems my employer allows modification to the plan for the case I stated. Of course that doesn't mean I'll be able to satisfy the counselor. Who knows what they'll be looking for.

 

 

You may make changes to your plan at any time during the year as long as you have a "qualifying event " as defined by the IRS.  This includes marriage, birth of a child, loss of coverage (for example a child covered under their parents plan that ages out).  Your immigrating spouse will most likely lose whatever coverage they have when they leave their country, and you should be able to add them to your plan.  Your have 30 days from the qualifying event to make the change. Otherwise you would most likely need to wait for the next open enrollment period.

I would have correspondence from your benefits department outlining the steps you need to take to add your spouse after their arrival available during the interview, along with a copy of your coverage.

That sounds reasonable. Let's see what the courts decide 🤞. Hopefully we won't have to worry about this.

I am wondering about this too...What health insurance should she have submitted? I thought being employed was sufficient but read somewhere that it isn't because that employee health  coverage kicks in within 90 days. Do you or does anyone know where to buy immigrant health insurance, or what should we do to observe this new rule?

i'm not sure...my husband and I both live overseas, so no US jobs at present.  not sure how to prove that you will get insurance- I plan to go prepared with which sort of plan we can get off marketplace and how we will afford that...but i'm not sure what documentary proof they would need.

Thanks a lot for the links. I know there is a restraining order on the rule, but I'd like to err on the side of caution. We now live in different times. I have contacted my HR/Benefits department this morning and I am waiting to hear back from them.

LOL Countless victims have gotten caught in the public charge trap over the years.  A health insurance card eliminates at least one criteria for that determination.

I was able to add my husband a few weeks ago, through open enrollment. They know that he may be coming soon. I pray that he does. So they accepted him. The life insurance policy was something totally different.

OK thanks for your update so is he in the US or has he gone to embassy? Is your husband from Nigeria?
