Traveling Out of country when filing AOS

Hi!

 

My Fiance is a K1, right now we are waiting on her social security number before we can get married... (Alabama laws are dumb) My question is, once we file for a AOS where can I file the petition to get international travel authorization so she can travel out of the country with me on Business while we wait for the AOS?

The I-131, Application for Travel Document, is usually filed with the I-485.

FYI - I'm almost certain that Alabama does not require an SSN from a non-citizen to marry; the closest I've seen any state come to this is Idaho apparently requiring you to have an SSN if you're eligible to get one and AFAIK that's the only state that does that. Are you sure you just haven't run into a clerk misinterpreting the law or an overly restrictive online form (this is way more common than state law actually requiring an SSN from a non-citizen to get married)?

 

If not, what's keeping you from getting married in another state? If the city in your profile is correct, it looks like you could get to Florida or Mississippi fairly quickly, and could even make New Orleans on a day trip ...

AP is taking 6 to 8 months,  so she won't be going anywhere for a while.   Some are actually getting green cards before this but that is local field office dependant

She can file for AP (travel authorization) with her AOS.  It takes about 6 months to get AP.  This is one of the major drawback of the K-1 route.

An SSN is not needed to marry.

Have you actually gone to the clerks office to buy the ML explaining she is a non citizen or are you reading websites that are written for US citizens or speaking on the phone to them and not explaining you're a non-citizen?
