No Client letter from Government company for H1B RFE

Hello,

 

My employer has filed for H1B this year and got an RFE to provide client letter (Employer-Employee relationship).

 

I'm currently working in EVC (Employer - Vendor - Client) model. Here the client is State Government firm. The client says they cannot provide letter on their letter head as it's against their policies. The employer says providing client letter would be strong case. I'm sure this is the case with all federal government agencies and though H1B still got approved working for them without having client letter.

 

Please suggest what are the other alternatives for getting this H1B approved.

I'm very worried. Please advise.

I don’t think there is an alternative. They are pretty strict on client letter due to H1B abuses by the consulting companies.

Spouse:

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

2016-05-10: N-400 Sent

2016-05-16: N-400 NOA1

2016-05-26: Biometrics

2017-01-30: Interview

2017-03-02: Oath Ceremony

The federal government? Really? So much for “buy American hire American”.

 

Anyway - i am guessing these people are not employed through the same middleman as you, maybe that’s what you need to look at.

May be few if not all provide the letter in some form.  Not everyone gets the RFE, may be those working there did not get RFE or were direct hires, too many variables. 
 

You are asked for it and you can’t opt out of that.

Please re-read what the “guess” was. It was that the middleman is not the same as yours, who seems unable to get you what you need.

Timeline

H1b's are dealt with by Lawyers, a Lawyer dealing with this type which is particularly under scrutiny would know how to respond.

Your company’s attorney team would need to handle the RFE response but I wanted to offer a few other ideas that can sometimes be used

 

pay records showing you are paid directly from the petitioner

corporate brochures outlining the benefits offered to employees

organization chart showing the structure of your team, including the people you report to and and people who report to you

a letter from your company explaining your position, the nature of the company, their work model and how traveling to a client site is typical for the position

itinerary that explains your travel schedule 

 

I definitely think it is possible to file without a client letter but your employer’s legal team should be handling the response and should handle obtaining any necessary documents
