Hello everyone I am new here. I am just kinda worried because we filed our son’s docs last Feb 2018, and it says case was transferred to National benefit center, summit lee last feb of 2019 and up to this date, no news yet. Anyone with the same case please? He was 18 when we filed his docs. Whats next for this one  pls? Thank you so much.

Hi I am just new here sorry but I’ll ry to answer all your questions:

 

my husband filed for i-130 PERITION FOR IMMEDIATE RELATIVE SON UNDER 21. No ds-260 yet. ACCORDING TO MY LAWYER, WE ARE WAITING FOR THE APPROVAL AND THEN THE BILL FROM NATIONAL BENEFIT CENTER, SO FROM THE TIME THAT THE CASE WAS MOVE TO ANOTHER OFFICE LAST FEB, NO UPDATE YET.

HI NO DS-260 YET BEC WE ARE WAITING FOR THE BILL FROM NBC TO BE ABLE TO DO THE DS260. MY LAWYER SAID WE HAVE TO WAIT FOR THE BILL COMING FROM THE NATIONAL BENEFIT CENTER. WHEN IT WAS TRANSFERED LAST FEB, WE DIDNT GET ANY UPDATE TILL NOW.

NBC has nothing to do with an approved I-130. After approval, the I-130 is sent to the NVC.

 

NBC is part of USCIS, which is under DHS.

NVC is part of DOS.

They are different department of government entirely. USCIS handles petitions and applications within the US. NVC, as part of DOS, handles visas. USCIS does not touch visas.

AND ALSO WE REQUESTED FOR AGED UP NEC HE WAS 20 AND TURNING 21 THE NEXT 10 MONTHS. SO MY LAWYER SAID “AS FAR AS WE KNOW” THE AGED UP WAS APPROVED. Your I-130 is not approved yet, so it is still with USCIS (at NBC now). It's just a waiting game at this point.

 

CSPA should preserve their eligibility category so they won't age out.

OH THANK YOU SO MUCH. ANOTHER THING IS THAT, WE REQUEST FOR AN AGE OUT BEC HE WAS JANUARY AND WE FILED HIS I-130 MARCH OR 2018 AND HIS DAD WAS STILL LPR BY THAT TIME. BUT COMES JULY OF 2018, WE UPGRADED HIS DAD’S STATUS TO CITIZEN SO HE BECAME A US CITIZEN’S SON. USCIS doesn't really care about their age at this point. They will just adjudicate the petition itself.

Once the I-130 is approved and sent to NVC, then NVC will evaluate what visa category they fall into. Since the child was under 21 when the petitioner became a US citizen, their age is automatically frozen. So long as they seek to acquire the visa (basically once they start the actual visa process) within 1 year from when the I-130 is approved, CSPA will protect them.

I filed for my son feb 2018 and he is here already for more than 6 months and your case is outside of normal processing time in feb 2019 I was already at NVC so you need to call them and find out what’s going on
