Hello again,

I now have a question that may be unique. I am about to file my 129-F and I found out that my company may be willing to have my fiance come over on a J-1 visa. Now my question is, if he comes over here for the summer, what effect will it have on our K-1 visa? If we marry while he is here, can we get a change of status or extension of some kind? I am hoping he will be here by January of 07 on the K-1, but if his being here on the J-1 will compromise that I would rather wait.

hey!!! alright if i were you i would just stick with the K1 if you are 100% sure that you want to get married. if you are still unsure then use the J1 to get to know eachother better. i met my fiance while he was here on a J1. there is a negative to the J1 though. depending on what country your fiance is from they could stick him with a two year restriction and in order for him to come back within to years on another visa he will have to get it waivered and it is more of a headache. so i would definetely stick with the K1 if i were you!!! so i hope that it helped somewhat!! good luck with everything!!

J1 visa is great chance for it. Forget about everything and just do it! Go by j1 visa!

I wish I stayed with my love when I was in the US by J1 visa.

Actually, this is not absolutely true: the reason and the source of money determines the two year rule.

1- if someone is financed partially or entirely , indirectly or directly, by the US government , his home governement or an international organization, HE IS SIMPLY SUBJECT....the Country has nothing to do with that...

2-when the person is a physician, the two year rule is automatic again, no matter his country

3-for reasons like the SKILL LIST, the country does matter because not every country has signed a regulation with the US in this aera. So the rule is not applicable for anyone whose country doesn' t have a shortage of certain skills;
