Thank you so much Wuozopo:) I was told to file concurrently from other people who were in the same situation and I have read on USCIS web that they both need to be filed:) wow, seems costly already! Do you know if there are two different fees even if filed together? Also the process times seems pretty long :(  I appreciate your responses!

If you do need a waiver then a child is not eligible to file one.

 

Trying to think what it could be that is sufficiently minor not to require a waiver but would get you deported and to be honest I am lost.

Did not any of the Lawyers you consulted not mention this?

It’s funny and confusing to me too lol 😂 

One lawyer did say I might not need one because of the charges 😆Another said we need to file waivers 😭 So basically I got tired of dishing out money to lawyers who are educated but give different information. Can anyone please give me an estimate time frame on how long the process is for these waivers? USCIS says 4-6 months but I’m not buying it! Thanks again

You need a Qualifying Relative to file the waiver, then it needs to be prepared, who is going to do that?

 

I 601 last time I saw is about a year from filing. May be shorter may be longer.

Children are not qualifying relatives for the waiver.  

In other words, your daughter cannot file the waiver.

I will do all the work. Definitely not paying my hard earned money to a lawyer that takes their sweet time and makes tons of mistakes. I know from past experience and I’ve read people’s horror stories on here. 😂

Well you have a lot to learn and a lot of research to do, a waiver is no easy task but many have done it themselves.

You're misreading this.  Your daughter is definitely not a qualifying relative for the 212.

In all honesty waivers are not really my thing. I did some quick googling and got conflicting info. Some seems to say a child is a qualifying person, other links said they are not. He has to file both the 212 and 601. Does anyone have a link they could provide him with correct applicable info?

 

Anyway- M&M- I understand you have had bad experiences with attnys before so its no surprise you are hesitant to use one for this. Your situation overall is a complex and unusual one, so its not surprising for you to get mixed and conflicting advice and answers from attnys. However you were now advised that you need to file the 2 waivers. I would strongly suggest you consider using an attny to do such. The thing is you can prepare the waivers yourself but you have a greater chance of them being successful if you use an attny experienced in preparing waivers.  Preparing waivers is a pretty standard procedure - nothing like the complex issues you had before. So you cant really compare your previous horrible attny experience with the complex issue to this. 

 

An attny can prepare the waiver in a way that is acceptable to USCIS, you are going to have a hard time doing such on your own. Attnys know the exact terms to use and the exact way to draft it so USCIS can approve it.

Why is there a need for an I 212, I only see an I 601.

 

Just look up who is a Qualify Relative, anyway the OP said he has parents who are.

Because the embassy said two are needed in their denial. They did not say he is eligible for a waiver, but only might be. They noted:

1) consent to reapply + 2) waiver

Thank you all for replying and I respect everyones opinion on this matter. Just wanted to clarify that I’m a female 😊 

and not a HE lol 😂 

Villanelle- I appreciate your honesty and taking the time fo do extra research on this as it’s quite different. Its hard for me to make a decision on hiring a lawyer because I have trust issues and they all say it’s not guaranteed. So far none has convinced me that they will succeed rather they talk about how much money is required for this whole process! I’m a very humble, genuine caring person and they take advantage of me :( It’s not in my nature to be aggressive towards them to get the job done. As I mentioned before, I’m just a Nurse and can’t afford to dish out thousands! I rather take my time and do research and put it together as best I could and pray for the best. 

I actually called USCIS and a lovely person said, my daughter can file waiver because of the criminal category. She couldn’t advise me more specifics as they are not legally allowed to but she gave me some guidance. BUT since I have citizen parents I will go ahead and gather documents on them. 

I know it won’t be easy but glad I can jump on here and other sites and ask for help. 

I’m hoping this topic helps any others who may go through this! 

Wuozopo- Thank you for suggesting the link for the lawyer! I’ve emailed them but no response yet:( Besides they are in NH, too far from my family and I would prefer local in UK if needed.

She provides a lot of info on her website which will help educate you about waivers, which are her specialty. And I believe she has a book out as well.
