If the house isn't in his name then kick him out of it and change the locks. As far as divorce goes that is really state dependent. So what state are you in?

I’m not sure it’s legal to evict someone from the marital home...

Hello. I am just looking for some advice. I have been trying to breakup with my husband for months. I keep asking him to leave and he doesn't want to. His conditional green card expired in August. He knew that I wanted to breakup and I wouldn't be going through the renewal process and I told him repeatedly go home before it expired. I have been treated like garbage since he has been here in 2016. I don't want to have to involve the police but I just want to get a divorce and be done. I don't really have the money for a lawyer and I was just going to do a DIY divorce but not sure he will sign. He is using me for a place to stay while he goes to work and makes money to spend on marijuana and to send back to his family. It's all so ridiculous and I just found out he is on a dating site. Any thoughts?  Thanks!

Call immigration and ask someone there. If he is doing what you are saying with pot, they will throw him out.

Depends if it's legal where the OP lives or not.

Not necessarily. It's illegal in my state and we've called the police for our pot-smoking neighbors multiple times. They'll go to the door but won't go in, even if they smell it, unfortunately. I don't know why! It depends on the police and the situation but couldn't hurt to try.

In the meantime, we're now moving to get away from the pot. :(

Unless it's in plain sight, they would need a warrant or permission. Smelling it is not enough to search a home (which differs from a vehicle, in which reasonable suspicion is enough to get a K9 to alert and then search).

I was not talking about him smoking pot, when I made this statement. The poster said something about him buying pot and sending it back to his family members. Does not matter if pot is legal in a state. It is against the law to send it through the mail, particularly to another country. I find it something though that someone would be so stupid as to send pot internationally, through the mail.
