Timeline

This may sound stupid but oh well. I was thinking of things my husband can do here while waiting for his EAD and what popped into my head was selling things on ebay. I have a TON of things that could sell for some $$...not a lot of $$$ but enough to get some spending money.

Would there be any legal implications of his doing this before getting his social security card? If so I guess he could just use my ebay account to do it with but it'd be cool if he could set up his own account and have it be his only. He could also bring a bunch of things from Egypt to sell as well as get them shipped to him from various sources.

02/05/07 - I-130 NOA1

02/21/07 - I-129 NOA1

04/09/07 - I-130 and I-129F approval email sent!!!!

04/26/07 - Packet 3 received

06/16/07 - Medical Examination

06/26/07 - Packet 3 SUBMITTED FINALLY!!!!

07/07/07 - Received pkt 4

07/22/07 - interview consular never bothered to show up for work.

07/29/07 - interview.

Its a grey area for sure. Personally I wouldn't worry about it too much though, unless its going to be a real business.

I'm suprised it hasn't been tapped into before by immigration. lol

I doubt he'd make more than a few thousand by doing this so I think the only thing needed would be to claim anything over $600 on our taxes. Just wasn't sure if there were any other immigration related things involved.

For example, on the same lines, starting your own business....do you have to have a green card for that?

Yes.

I don't agree with this. I believe as long as you are in the country legally you can start your own business. And anyway by the time you would be required to file taxes for the business you would have SSN and GC. Just my opinion.

Correct me if I am wrong, but I remember a while back there was a great debate about this and the spouse can help in a family based business. No real salary, but they could benefit from the proceeds.

I don't agree with this. I believe as long as you are in the country legally you can start your own business. And anyway by the time you would be required to file taxes for the business you would have SSN and GC. Just my opinion.

if you agree or not does not really matter, opinion is not law.

There is no guarantee that you will get the greencard or EAD by years end.

Of course you can start your own business - you just can't work for it.

It wouldn't be a USCIS issue, it would be an ICE issue, and they can't keep up with checking on big businesses let alone find time to seek out sole proprietors.

As for the taxes, that's an IRS issue and all they care about is the money, not the immigration status of the tax payer.

Working is working regardless if it is for your own business or someone else's, I do not believe the USCIS makes any kind of differentiation between the two. It obviously is easier to "fly below the radar" if you are working for yourself but that does not mean it is proper.

But an ebay store would not need a license though, if I'm not mistaken. Some people actually use that as their business.

As I said above, its a grey area, Ebay. There is a line between selling stuff on Ebay, and running a business selling stuff through Ebay. I would guess there are many people on Ebay that don't have business licenses, but really should have.

Maybe in some places, but not all. My wife once ran a business out of a shop in a little stripmall, never had or needed to have a business license.
