You are an immigrant. Are you not pursuing a K-1 visa? Isn't that listed in the drop down box? There's your answer.

They stated they are the sponsor.  They already live in the United States so they aren't an immigrant. An immigrant is a person who comes to live permanently in a foreign country.  They have lived in the United States so that doesn't apply to them. It may be asking for the beneficiary's immigration status which you would select their country if that is the case.  Some people don't like to be helpful to those who don't understand.

We are talking about her profile that is confusing to me as it should say that she (the beneficiary) is pursuing a K-1 visa. Her's says "other".

 

BTW, yours is blank so we don't know what visa you are pursuing. To change that select your icon in your profile on the left column (J), then select "edit profile" found to the right side of the page and then complete as shown below. This is about the beneficiary.

I am not an immigrant. I am a US citizen. My fiancé is the one pursuing the K-1 visa. I evidently looked at that question wrong. I thought it was asking about the process we were going through that brought me to this site. I’ll go back and change it.

These last 10 days have been brutal. God works in mysterious ways... but so does the USCIS . Meanwhile, while checking for any update nearly every other hour, I just keep trucking on at day 122. Hope everyone has a great weekend

Hi Everyone, 

 

We recently received our NOA2 and I am looking for guidance on the Affidavit of Support form as we continue with this process. My partner and I applied for the K1 while we were finishing a master's program in México and immediately following the program end in January I returned to the states to start working. I meet the income requirements well above the federal poverty level but I am worried about providing previous W-2 documents to prove income as the past two years I was in México studying. In this case because I have little recent history of income in the US does it make sense to get a co-sponsor? I just want to be especially careful, given all the changes to public charge rule Trump has implemented recently.

Future income cannot be used to support you now. Neither can past income. They will care about current income first. At the time you present the I-134, it needs to show the petitioner's current income...that is how much they are earning at that time. The past income may be considered for the public charge piece as well, but current income is what is required.

 

It may be wise to seek a co-sponsor for now just to have in your back pocket at the interview. Then if the petitioner does land a job paying better by the time AOS comes around, they can qualify on their own. The I-134 is not binding, and they do not need to use the same sponsor (or any other sponsor at all) for AOS after marriage.

 

What is needed for a clean financial package.

 

EVIDENCE OF SUPPORT: You must submit any evidence which will show that you and members of your family who will accompany you are not likely to become public charges while in the United States. Visa petitioner (US Citizen) will have to complete form I-134. If the petitioner does not qualify as a sponsor, a Joint-Sponsor should ALSO be presented (any US Citizen living in the US or Legal Permanent Resident), who will also have to complete form I-134. Both, the Sponsor (Petitioner) as well as the Joint-Sponsor, will have to present last year's income tax return transcripts. W2 form and proof of current and sustainable income (e.g letter of employment on letterhead including salary and start date, most recent salary receipts, bank accounts, the value of properties, etc.).
