F3 derivative beneficiary with learning disability

Hello,

 

Can you please help me with one question?
 
I am a UK citizen and father who lives in USA a US citizen.
In 2010 my father filled I-130 F3 visa petition for me and my family.
My 8 years old son has severe autism and learning disablity.
He is non-verbal.
 
Will my son be consider inadmissiable for USA immigration and will be denied
immigration visa to US?

It will depend upon how this public charge/health insurance issue turns out, and also what resources you have to provide for your son's care after you immigrate.  He will not be eligible for any public assistance.

 

Are you in a position to provide for his care without government assistance?

Thanks for your reply.

Seems like I will have to have my fingers cross for Public Charge/Health insurance issue.

Yes me and my partner will provide for our son care without any government assistance.

 

If you ignore that upcoming issue (public charge etc etc,.) what are the odds of obtaining green card for a disabled person?

It is not considered an ineligiblility

Heads up for his visa medical-- among the items they list to bring 

  • When there may be special educational needs, please provide any recent educational, psychological assessments, school reports etc.
