Mom denied a tourist visa, I'm in CR1 process HELP

Wanted to post to say that Boiler clarified some details about the thread I referred ealier. I'm on my cellphone so my ability to look at previous threads for details is limited. Referred to that thread from memory (which is slowly fading 😉).

Only my husband lives in the US. I guess next time we can try that, but honestly I think we're gonna have to wait a few months, or years.

I think she can re-apply after several months. But it would be great if you guys can come together. :) Keep the faith.

Thanks. We are in no hurry for her to visit because I don't even live there yet, we just wanted to get her visa to have one less thing to worry about and she could visit later on. 

So I'll help her apply again in a few months.

That letter has no impact on their eligibility for the visa. They need a reason to return home, not a reason to want to visit. From the DOS directly: https://travel.state.gov/content/travel/en/us-visas/tourism-visit/visitor.html

100% agree, we can all thank those who manipulate the system for making it much harder for those that don’t have ill intent..

Well with my parents’ case those were really the reason, two seniors who wanted to visit the son for vacation. And right, the letter was only brought during interview. they did not stay there by the way. Sorry if you guys thought my message was misleading. The admin can just delete it if they like. No worries.

She does not want to live in the US, but she also does not want to miss the opportunity to be with her grand daughter (my daughter).

So after a long conversation, I apply for her IR5 (immigrant visa) to come to the United States and start her whole new life here. She has to leave my brothers (11 and 19 years old), a house, friends and family. Regardless, it will be different case if she just get her tourist visa instead of immigrant visa. We all have things to consider...unfortunately, there are price to pay :(

4/19/19: Sending Package to USCIS

5/8/19: NOA1 (USCIS received)

10/3/19: NOA2 (USCIS Approved)

10/10/19: Case sent to NVC

10/22/19: NVC received

11/14/19: Received invoice number and case number and pay AOS + IV bill

11/18/19: Completed DS-260

11/19/19: Submit AOS + IV package to NVC for review (hit the 7 months mark!)

11/21/19: All documents are accepted except tax transcripts. Re-upload it and now upload 1 year per document section.

01/22/20: Document Qualified. NVC send it over to embassy for obtaining interview date.

02/12/20: NVC completed the case. Now the status is in transit to US embassy (Jakarta-Indonesia)

03/05/20: Medical Exam

03/26/20: Interview date!💖 (canceled due to Covid-19 until further notice)

02/25/21: Embassy emailed that they resume IR5 visa

03/01/21: Another medical exam since the last one expired in September 2020

03/15/21: Interview date!🤩 Result: 221G because my mom forget the original doc for my dad's death decree + she needs to redone her photo

03/16/21: submit the necessary paperwork + photo

03/17/21: Status change to administrative processing

03/18/21: Status change to issued. Waiting for email from the embassy for pick up

03/20/21: VISA IS READY!

03/25/21: Fly to US

You’re right! leaving my own minor 11 year old child behind to look after someone else’s child does not fit my mindset.  

But the actual point was your phrasing of “had to”, no-one is being forced to do anything here - it is all your choice of what to do.  You could equally say you “have to” return to your home country to keep the extended family in one place. Your choice, nothing forced.

Maybe it would be better to deny adjustment of status to those who entered on a visitor visa? Although not sure immigrants would ever come forward if they know they'd be denied. 

 

To all: 

I am still super bummed about my mom but we can't lose hope. I'll help her apply again in a few months and will reach out to some local people who know about tourist visas etc maybe they'll have some advice. If it all fails maybe I can apply for my mom's immigrant visa in a few years, if that's what she wants. Honestly this isn't our first option but might be the only one.

40% of the undocumented immigrants in the US came in with inspection.  That's over 5,000,000 people.  2019 is the 7th year in a row where the number of visa overstays was higher than the number of illegal border crossers.  Visa overstys is the number one source of undocumented immigrants.

 

I have plenty of relatives who if given visitor visas would come here and never leave.  That's the reality of life.  My family is no better than anyone's else family.  The reality is that many people are willing to live in the US undocumented.  

 

What would you propose?  No presumption of immigrant intent and let everyone who wants to visit in?  What would that do to the number of visa overstays?
