Need advice on A/P

Good morning,

My fiance's interview is next week and now he found out that his grandmother is really sick back in Ukraine.

What will happen if he'll come here and we won't have our AP approved yet and she'll get worse ( god forbid) and he will go there to see her before something will happen to her.

I guess my question is: how long does it take to get approval for A/P and how soon can you apply for it?

He can send in the AP application along with his AOS application (this'd be after you are married and have all the documents needed for the AOS application). it usually takes 90 days or less to process the AP application.

Once he has sent in his AOS application, if he needs to leave the country due to a very sick relative, he can apply for an emergency AP which'll let him leave almost right away if approved.

02/13/2007 -------- EAD Approved!

02/26/2007 - ------EAD received

Removal of Conditions:

05/12/2009 -- Overnighted application by USPS express mail (VSC).

05/14/2009 -- Green Card expired.

05/23/2009 --- Check cleared bank.

05/26/2009 -- Received NOA (NOA date May 15, 2009, guess they aren't deporting me).

05/29/2009- Biometrics Notice date

06/01/2009- Received Biometrics Letter

06/18/2009 - Biometrics

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.

You'd have to get married asap, then file AOS w/AP. Normally it takes AP about 90 days. But if you'd need it immediately, you'd have to make an infopass appointment, present the emergency and they'll give it on the spot.

If you say the emergency is that the grandma is very ill and he wants to see her or help in her care, I suppose a letter from a doctor would be very helpful. Maybe someone here who has done an emergency AP at the infopass appointment can help with more info?

If he enters US & leaves before marriage, you'll have to start all over with the K1. If you get married and he leaves right away, you start the K3, while he's in Israel. No matter what, if he leaves without AP he can't simply return as the K1 is a one time entry visa.

After interview, why doesn't he go to the Ukraine, stay with his grandma whatever time he needs (provided its less than 6 months, because K1 is only valid for that long). When he's ready he'll come to the US and then you can get married & file AOS with no rushing.

That's exactly what I was going to suggest to avoid the stress of not being close to his grandmother while she's failing, trying to celebrate your marriage and start you life with possibly the burden of having to return home right after the ceremony while waiting for your AOS and I-130 NOA1 to want to apply for Emergency AP, just sounds horrible to me. Personally, IMO I would suggest that your fiance after his interview go to the Ukraine to be with his grandmother as long as he needs to be (within the 6 months) then he can come to the states, marry and start his life with you without feeling guilty or needing to abandon his immigration and cause further seperation for you both.

Esli visa sama po sebe deystvitelna 4 mesyatsa po moemu to pochemu by emu ne s'ezdit domoy kak babushke pered tem kak priehat v US? Potom uzhe posmotrite potomu chto nikto ne znaet chto poluchitcya i kak bistro no hotya bi on eyo uvidet pered tem kak ubezhit.
