Hi 

 

I am considering writing to USCIS to cancel my K1 application (so far I have received NOA1). I am instead going to have a quick wedding in the UK and go down the DCF route. 

Does anyone know or have experience with cancelling an application and whether this will effect future applications? If there’s any chance cancelling an application gives us any kind of black mark I’m not sure it’s worth it and I might as well just continue with the K1 route.

No black mark.  Your circumstances have legitimately changed.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Due to the potential gravity of your situation, strongly suggest that you send the letter certified, return receipt requested. You don't want this statement to come back and haunt you.

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)

Come back and haunt me, as in if for some reason it wasn’t received and the application wasn’t cancelled I would be in trouble? Letter will he sent my international courier and certainly with a delivery guarantee as it will be travelling from the UK to the US

It should not be an issue .. but it’s possible that there can be unclear information on file .. so going through the step of having the K1 cancellation added to your record may prevent any confusion as your new petition is processed

Keep in mind that you can only DCF in the UK if you are a legal resident there. 

You can't just go to the UK and apply for DCF after marriage. 

I suggest you read all of the requirements first, before pulling your K-1.

Yes I am a UK and US citizen. My partner and I have UK residency currently (joint home owners) and we are looking to relocate to the US

Did you read this part in the link I sent to you? You might want to double check with the embassy first, before pulling it.

If you don’t have to give 10 months notice, the processing times are quick!

 @ek1357  Looks like you started the process in August and if everything goes well you  may get your NOA 2  the  3rd or 4th week of november and then your interview.  On the other hand given the information above, if you choose DCF , looks like you will get your documents ready within 3 months. (The good side  is that at least you will have the security that it will be ready within three months, unlike K1, which really does not ensure an estimated date)

Just a heads up. When I sent a cancellation letter to the USCIS for a K1 for the ending of a prior relationship... I sent the letter in November 2018 and didn't receive a response from the USCIS until March 2019. When I filed the I-130 for my current spouse, I attached a photocopy and explanation of the cancelled K1 explaining the relationship with the prior fiance had ended many months ago and I sent a cancellation letter to the USCIS. You should be fine, the USCIS won't punish you for sending a K-1 and cancelling it for the same girlfriend. They tend to review petitions of serial filers more stringently (someone who has filed for 4 separate beneficiaries).
