We have been revoked after a long battle through our I-130 process.
My husband and I have talked in depth about filing an appeal however I think it is better just to re-file. (3+ year process down the drain)
We just fired our Attorney who responded to our NOIR as she didn't file everything I sent her for the NOIR saying she didn't want to over burden them with our 5+ year relationship, 3+ year marriage.

My question is should we withdrawal the file or let it be revoked completely in about 20 more days?  How does it effect us when we re-file.

First you are doing the best thing not to appeal

I appealed and it took 1 year and the court verified my marriage as bona fida but said to reapply / and an appeal can take more than 2 years

when you know the reasons for the revocation ,   be prepared to send proof the embassy issues are wrong with the new application

Since ours was from  a decision of a previous CR1 i did not withdraw it but if you do not appeal ,  I would send letter to withdraw with the new IR1 application

this time be prepared to prove commingling of finances like adding him to tax returns,  getting a POA,  adding him to bank account once IRS issues the ITIN,  each of you create a will in favor of the other (even if there is little property) ,  adding him to a life insurance ,  adding him to a utility bill.  I even used the POA to add Adil  to my deed with a quick claim deed / costs me $15

sorry you go thru this /  took us 6 years and i know the heartbreak and frustration 

incha  allah you will succeed

my husband is here and now a citizen so i know things do get better

We were going to appeal but I just terminated our Attorney and we just don't know how an appeal will go after such a difficult I-130 process....super disappointed in the process. We do have everything except I cant find a bank who will add him to my account without him being here in the states. How do you do that? They wont add me to his bank account in Egypt as well.****I even used the POA to add Adil  to my deed with a quick claim deed / costs me $15***pardon, I don't know what that means? I tried to add him to my electric bill and they said no. However he is added to my water delivery service. We have 3 years of filing married joint taxes, he has an ITIN #.

Yes this is very heartbreaking........what should I say in the withdrawal letter?
Insha'Allah sister this next application will be rock solid with proof of relationship.

Don't do an appeal   /just reapply and prove the embassy issues are wrong (proof the issues are wrong is needed)

 

even foreign workers have a US bank account here /  it is under federal laws

 

You are not required to have a social security number to open a checking or savings account. ... If you don't have a U.S. government-issued SSN or ITIN, some banks and credit unions will accept a passport number and country of issuance, an alien identification card number, or other government-issued ID number.Mar 15, 2017

Yes they will except it but they want him to come into the bank. I just need a bank which will do it, do you know which one?

We are not going to appeal. Should I front load our new I-130 and also file a K3? Someone told me to file a K3 after we get NOA1...is this true?

Hey!

 

I was able to get on my husbands account in Egypt thru CIB Bank.  I hope this helps for co-mingling finances.  I was also able to add him to one of my credit cards here, car insurance as a non driver, beneficiary for some of my accounts, and more.

Did you have these done as well?

First Trip - October 2015

I - 130 Stage (USCIS):

November 13th, 2017 - I-130 sent

November 24th, 2017 - NOA1 (Received Hard Copy by Mail)

June 7th, 2018 - Online Case Update - Case Transferred and /New Office Has Jurisdiction

June 8th, 2018 - was told my petition is being sent to The National Benefits Center (NBC)

June 8th, 2018 - Online Case Update - we received your case

June 8th, 2018 - Online Case Update - Case Transferred and New Office Has Jurisdiction

June 14th, 2018- Hard Copy of Transfer Notice (sent 6/6/18)

July 9th, 2018- worked with caseworker at congressional office, made a inquiry

August 3rd, 2018 - caseworker was told by liaison that my case had been transferred to another department for review

August 17th, 2018 - expedite request sent per caseworker, due to USCIS error.

August 27th, 2018 - our petition was yet again sent to the wrong office (Adoption Unit...) another request for expedite was placed by caseworker.

August 30th, 2018 - petition was sent BACK to Nebraska Service Center.  Caseworker spoke with NSC liaison detailing the erroneous transfer that has put your case behind normal processing times, as well as the delays/lack of communication/action at NBC"

September 13th, 2018 - Case was transferred to a new office

September 14th, 2018 - Case transferred and new office has jurisdiction - called and they said it was at Nebraska still...

September 14th, 2018 - Case is APPROVED

September 17th, 2018 - Hard Copy NOA2 Received (PD SAYS 9/13/18)

September 26th, 2018 - Sent to the Department of State (online notification)

October 2nd, 2018 - NVC Received

October 26th, 2018 - Case # Received via email

November 7-9th, 2018 - Submitted DS260 and AOS, Civil Documents, etc. via CEAC

November 14th, 2018 - new police certificate was uploaded

November 27th, 2018 - Case Complete at NVC!

Feb 14, 2019 - Received interview date via email

March 5th, 2019 - scheduled interview date - APPROVED
March 9th, 2019 - Visa in Hand
