Why RFE with mountain of evidence

Timeline

Apologies ahead for creating this when i am yet to even read the content of the RFE as i am yet to receive the letter in the mail, but email and website says RFE sent.

I get sleepless nights and can't understand how one gets RFE after sending loads of pictures of our family introduction along with wedding pictures with both families,

pictures of us at different events over time and parties together and some times with same event attire, i sent in birth certificate of child we have together with pictures evidences, wedding certificate sent also reflect we have a child together before the marriage and wedding was from an acceptable court, there are pictures of us celebrating my child's birthday together.

how does this even work?

 

The only thing i did not have my wife do is change her last name to mine, which in my opinion is a choice she can do if she wants to.

 

 

 

 

Got LPR status through family in Feb 2017
travelled back to Nigeria in Aug 2017, got married
file i130 for wife and daughter in January 2018
Case transferred from CSC to NSC in July 2019
got RFE in Oct 2019.

What about financial commingling of the marriage evidence such as joint bank accounts, etc?

I 130 sent in 2009 so must assume you married in that year or before

so,  how many times has the USC been to Nigeria?

How long were the trips?

Nigerian needs to see loads of time together / you mention plane ticket ?  just 1?

Has the USC done the paperwork to put the Nigerian on tax returns by applying for a ITIN

Has the Nigerian given the USC a POA to do business on their behalf like signing name to tax returns?

Added to bank account using the ITIN after IRS assigns one?

each of you done a will?

or added to any life insurance policy?

Added to deed to house with a quick claim deed?

Add to a utility bill / i was able to add him to water 

 

i did all of the above to get the visa approved

I also made 5 trips (all over a month / 2 of them were 3 months)

you deal with a difficult embassy like ours

gotta do what immigration expects to see to show the relationship is real

Yes, they have those too, though i will include more recent ones this time and anything i can remotely think of,

These are not as strong IMHO as having a child together and then getting married afterwards with pictures proving relationship started long ago if we decide to be honest here.

 

 

Though i have more evidences of 2 different family trips to the UK, another to dubai plus more financial and call logs, pictures etc since i filed,

 

My getting RFE just proves we have to still be ready for the worst even when you have dotted your i's and crossed your t's

Sorry for the confusion @Jeanne Adil, i will try to update my profile as that history is when i arrived as LPR, I am now trying to file for my wife and daughter.

 

i actually arrived US,  got LPR status and travelled back, got married, came back to US and filed 5 months later.

since case filed in 2018, i have travelled back to nigeria once, have us all meet in the UK twice this year, paid their trip to dubai last year and this christmas, i will be back in Nigeria to spend christmas with them.

Those evidence now exist which did not exists at that time

 

But then, I have seen cases approved with just married certificates, call logs and bank transactions, call logs and transactions are not even solid if you know what i mean.

How did you become a LPR? Were you previously married to a USC?

Or maybe you simply forgot to sign a form. Or maybe they lost a form that was in your packet. No one can tell you what it is. Just be patient, wait for the RFE and send what they ask for.

Timeline

Wait for the letter in the mail with the specifics of the RFE, it might not be about the legitimacy of your relationship. Perhaps a document that is missing, or some other thing. We got an RFE for a birth certificate that had been ammended. I know it's hard not to worry, but try and wait and see what it is before you jump to conclusions.

Financial commingling is one of the most important evidences. Joint bank accounts(With activity), health, life, dental, car insurance, rental agreements, call records, proof of address, etc., together with what you sent. That’s what we did and I got the green card no RFE 🌚 good luck 👍🏽🍀
