No I-130. I-130 is only required if they didn't marry before the I-94 expired.

Thanks, couldn't remember the prereqs.

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)

It's not that unusual for a CO to make a mistake with a BC. It happens with Canadians fairly often (incorrectly accepting a short-form BC when they need the long form one)...requiring them to get the correct one for AOS. People have received RFEs/RFIEs for supplying the wrong one.

At this point, it might be best to file with the document you have right now, and start the process to get the right one. I usually don't suggest filing without all necessary documents, but the alternative of going without status is a bigger risk.

In capital federal I was able to get a birth certificate in 2 days ,paying express on the internet ,are you sure you can’t do it in Santa Fe?

Right but you/ spouse were BORN in Buenos Aires and you retrieved it in Buenos Aires?? That's easy.

Our problem is he was BORN in Santa Fe and we tried to RETRIEVE it in Corrientes and Buenos Aires. When it ships from a different city apparently it takes 2 months, or so we were told.

The Santa Fe online link requires Numero de Acta, Tomo, and Folio. Where do we get this from?

Hindsight is 20/20... sigh.. we should have traveled to Santa FE :(

UPDATE: so I contacted a private company in Argentina that retrieves birth certificates and other things for foreigners. The estimated time is 20-30 days.

The question still stands... Should I send i-485 now before 90 days are up in a week or should I wait to have the birth certificate in hand before filing AOS given this new timeline?

Thanks for your advice!

I suggest you send it now. If you get an RFE it takes roughly 90 days for you to respond to the RFE. Make sure that you order or request that birth certificate right this minute also. Better get on with it just Incase there’s unforeseen issues that might come up.
