It is hard to say what they will do next. But you gave them a huge piece of evidence that may put him in removal proceedings. The police report and the  pictures from that report are the best pieces of evidence they can get. 

 

Do not what so ever go to that interview. They have your proof of abuse let them deal with him.  

 

You have mentioned a few different things. At what stage is he at? Does he have his first GC? Is he applying for removal of conditions?

1) Make sure you are safe. This is always priority #1! No exceptions.

2) It sounds like you already have police reports. Good. let them deal with his offenses.

3) Immigration-wise, you can possibly complicate the ROC process for him, but domestic abuse alone is not a cause for removal, and not something of importance with ROC. ROC is about determining if the marriage was entered into in good faith. The only potential issue would be if his crimes would make him inadmissible....AFAIK, that doesn't seem to fit here. That might change if it is is treated as an aggravated felony...but honestly, I would be surprised if that wasn't challenged. It sounds like a horrible situation, NOBODY deserves that treatment, and I wish you the best moving forward. But it's not really an immigration issue. It's a criminal issue.

I’m not sure you can claim him as not entering the marriage in good faith... that and violence are two totally seperate issues..

Yea, but we dont think we had enough evidence.  We sent a bank statement car note and pictures were old. There was only 8 sent that's it. Oh a 2 letters from folks . 

I sent in yesterday the police report that says they have pictures and they say the bruises on my neck and she told.me.to write a letter explaining what happened.

Could they ask for an interview. How do you proof marriage was a fraud . I feel it was because he used me . I saw the signs. But I was blind.

Can they ask for an interview with just you? I don't see anything that prohibits them from requesting it, but it would be incredible unusual. I would not expect to be interviewed. You provided the evidence you had.

 

Proving fraud is incredible difficult. You provided evidence that it was not fraud in order to convince a CO and get a K-1 visa. You then provided more evidence that it was not fraud in order to get the green card. It's very hard to show that everything you provided previously was for a wrong result. It generally would need something concrete like text messages saying he only married for a green card, he has another woman back home and intended to divorce you and bring her the whole time, etc. Circumstantial evidence and feeling or suspecting that he used you just won't cut it.

 

Best thing to do since you already provided USCIS with the evidence of abuse is to keep yourself safe and try to move on. His immigration path is no longer your problem. Let him deal with his demons there.

Best wishes. You've been through a lot, but you'll come out stronger in the end. Time to heal.

I know it is difficult.

I had a 10 year relationship in a bad relationship. 
5 yrs where my son was alive. I stayed for my son who is now 14. I thought it was the “right” thing to do. 

I left him  finally when my son was 5 and thankfully my son does not remember it. 
With the evidence you have, you should file a restraining order including your son on the order. 
I was granted a one year order and my x was forced to get help. 
It did not stop him from trying to contact me but each time I called the police, in result he violated the order. 
He also tried to get custody. Not because he wanted him, but to hurt me more. 
Keeping your child and yourself safe is 1 as depending on your state they can give him half custody regardless of what’s happened to you. 
Please do not help him with his immigration as they will think what he’s done to you that you have now forgiven him. 
Go through the courts. It took me years to heal but it will happen. 
Document everything as you never know what he may do to hurt you emotionally as well. 
I stayed long after my x’s expiration date but you do NOT have to. 
I gave up everything to keep my child safe and you WILL end up healing. 
It may seem hopeless now but I promise you that if you are happy than your child will know that and both of you can lead a very prosperous life. 
I now am with my fiancé from London with 2 beautiful children and a wonderful man. 
I am so sorry he has done this to you.
