Tonight my husband beat me and bit me because I got mad because hes talking to another woman. I got so angry he very disrespect to me so I throw a basket barely touch him. So I called the lady and he disnt defend me at all beat me with her on the phone. He hit my son because he was trying to defend his.mom. we are going to immigration tomorrow. I want to with draw. He has got as far as  going for the biometric. But we havent heard anything else. If I go to them to show them my bruises will they let me withdraw

 What can I do I dont want him to get nothing I feel used. I feel he hates me.i lost everything job been very I'll dealing with stress behind him.and his daughter she is 7 she has no respect for me at all.

Please need advise. I'm working on leaving but I have nothing . I paid so much to get him and his daughter here. My dad.just died this past week I have not even buried him.yet 

He asks as if I should not speak up. Were married respect me.

Withdraw your I-864 if you already sent in their AOS

Find another place to stay and never stay alone with him. 

File for divorce. Change your phone number. If police was called, they take DV seriously and it can be taken against him.

You can't withdraw. Even if a marriage has evidence of abuse it doesn't mean there is fraud. Marriages fail all the time, unfortunately, women hey abused in marriages that have nothing to do with immigration  I'm sorry you're going through this. You have to prove fraud not that he is a bad husband.

What you need to do is protect yourself. Report it and get out.

He can complete the process with a divorce waiver, his immigration issues are his, well of course you will still be on the hook for the I 864.

Immigration officers do not work directly with domestic violence, they will not do anything for your case at this point. You should report to the police, move out and protect your son and yourself, that should be your priority. Never stay alone with him again, keep all text messages, pictures, phone calls, etc that prove his abuse/infidelity, that will be needed for the future, if not for the domestic abuse charges, at least for the divorce. 

 

Regarding immigration, the only thing you need to do is to file for divorce and make USCIS hear of this. He will still be able to apply by himself, if he can lift the restrictions or not it is his problem, not yours. You can file a visa fraud report but unless you have material proof that he entered the marriage in bad faith just to get the visa he will have good chances of not being denied. Just being a terrible spouse is not proof of visa fraud.

 

If he has a cunning lawyer or some brains he will try to charge you with domestic abuse, be prepared, gather proof, find a lawyer, do not meet with him or talk with him alone. If he has a lawyer, everything you may say will be used against you.

As he already has his green card there is no longer anything you can do regarding his status here. He’s here for good if he wants to be. Focus on you and your child. Get yourselves to

a safe place and start divorce proceedings. Do you have a friend or family member you can stay with? Report his abuse to the police. He needs to be punished for his actions against you and the child.

Get the authorities involved to help protect you from more physical harm and everything else.

Please call the police as well. This will help protect you now and in the future. Please don’t JUST see this as an immigration issue. Please get the police involved. For the sake of you and your child as well as any other people he may come across in the future. Good luck.

call the police.. report him him and put him in jail

Ok went to immigration . They ask me to write a letter explaining the situation. Then they want the police reports. I gave them that. Now, what happens if I dont go to the interview. I did not ask that.

The police report says how he choke me and they have pictures. 

Can he get his green card if I dont come to.the interview
