Are you filing AOS for a K1 and K2?

If so, yes you will file and pay for two seperate packages for each AOS applicant.

I485/I864

I765

I131.

Yes k1 and k2 so when you fill out I-864 it already ask who bringing over !

But you will be filing AOS for each immigrant individually regardless if they appear as dependent or parent on each others forms.

This is not like I129F that a K2 can be a derivative applicant.

AOS does not allow derivatives.

It does make sense, if you think about it in a weird USCIS-kinda way. I sent in my wife (K1) and stepson (K2) AOS packets and paid with one check. If there is a problem with either one of them, they will send both back to you for correction, same price.(because you are filing a K2 with a parent's K1).  If, on the other hand, you pay with 2 checks (1@) and say only the K2 is rejected for some error that you made. When you resubmit the K2, you have to pay full price, not the discounted price because the parent's K1 has already been filed, i.e. you are now filing them separately. Check out the fee schedule. I believe it actually happened to a recent K1/K2 submission recently (within the last month). Check back in the AOS forum. So, do you feel lucky?

Quick Update : Per new USCIS policy if the family based documentation does not contain I864 then the i485 will get denied and the beneficiary will be put to removal proceedings unless they have another in Status condition.

 

Came across two new cases in the last week like this. both got denied no NOID or RFE/RFIE.  i am trying to find the new guideline about the policy change.

So how would I write it again ! Why not make copy and jut add it in ! Part 2 is where the confusion is ! Because it asks in part 3 about 

any children !
