It is an important distinction, but it goes to the underlying requirement. If they are deciding to offer the OP the position or not based upon their ability to obtain work authorization, they are exposing their company to possible litigation.

I agree that it sounds like they just want info to help the OP here so it's a theoretical issue.

 

But the means to help here is crossing into areas that they are not supposed to be involved in. The employer only needs to know if they are going to have to sponsor the individual, not where they are in the immigration process, their current status, etc. This changes once an offer is made and/or I-9 is necessary, but it's not supposed to be part of the hiring process as it can be used for discriminatory purposes.

Even if that’s true (which I don’t think it is), it is their problem. From the immigrant’s perspective, which is what OP is seeking, there is no problem.

It is illegal to even ask about work authorization in a job interview.  The EEOA prohibits this or any other question that could be the basis of discrimination.  From the OP's post it appears that this information was given to the employer voluntarily which is completely up to the job applicant to disclose, but is not required.  Someone without work authorization can freely apply for jobs and interview without saying anything about their legal status in the US and even get a formal job offer.  The problem with this is when beginning the job, usually the first day of work, satisfactory evidence of work authorization must be provided when filling out the onboarding paperwork.  Without that, in this case, the EAD or green card, the OP cannot legally work.  OP, you can give the potential employer any information you want to, including SSN or USCIS numbers, but they cannot require you to give them your USCIS information or legal status, it's up to you.  Many companies do background checks on job applicants and for this they can request a driver's license number or SSN, but you don't have to give them your SSN until you actually start working.  They can do the background check with your name and date of birth.

And I assume that covers paper application questions?  I know of someone who just applied for a county school district job and the application itself specifically stated "Are you a United States Citizen?"    Also, when my wife was looking for work, she would get these phone calls and the very first question out of their mouths,  "Are you a United States Citizen?"

Most employers shouldn't do that: https://www.eeoc.gov/laws/practices/inquiries_citizenship.cfm Instead, the paper application can ask: "Are you authorized to work lawfully in the United States for _______ company? Note: If hired, a Form I-9, Employment Eligibility Verification, must be completed at the start of employment."

It is not rare to get expedited for EAD if you meet the requirements. If you want to file for an expedite...do so. No one here should discouraging someone to file for an expedite if they choose to.

So true!

 

i got my EAD expedited due to a job offer pending.

 

Also,  a Cover Letter was faxed along with a Job offer  -  not a word about financial hardship in the letter, but I did mention that the opportunity like that doesn't come by often and etc...

It took about  2 weeks - from the moment I placed the request (over the phone) to  the moment the card was received. 

 

I'm not saying that a request to expedite always gets an approval.  But it is really worth to try if you have a gob offer and you are willing to take it.

I feel a lot of animosity coming from a lot of users on this forum when you mention wanting to expedite your EAD because of a job offer among other reasons. Your story gives me hope :)

I would not use this letter for this expedite reason. The company that wants to hire you is fine and dandy if they want you to take over 2 positions. I hope they will pay you for the job of two. Sounds like they are doing what many companies do and cut out a job and make other employees pick up extra work to save them money by not paying. 

 

Anyways, back to your expedite request. The reason you need the expedite has to be for you. Not the company.  Get a normal job offer written and have your reason clear as day. Without a real offer any letter will not help you.
