Hi all,

 

I am waiting for my EAD but I have a potential employer who has offered me a job. They have not issued me an official offer letter to use for an expedited request but instead they want their paralegal who is in charge of immigration issues to write me a letter for the expedite. They asked me to provide them with my USCIS receipt for the EAD. I am not sure why they need that information and what they are going to put in that letter. Is it ok to give this information to them? Any ideas about this?

My advice: Wait for your card (like everyone else). Getting an expedite approved requires excellent evidence of immediate need (severe financial loss, etc.). What is the reason for you to get special treatment? Why should the government put you in front of others? Do you have unusual circumstances whereby your family may incur severe financial hardship if you are not working? You can give them the info and see what happens. Any letter sent to USCIS must have proof (letter from a physician, etc.). It's rare to win an expedite case, but it will not delay your current application. Be patient.

Have you asked them why they need the information?  It seem logical that they just want to tie the letter to you by the case number........but I think you'll have to have a hard job offer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

It is a position that they created specifically for me as it turned out that I have 2 special skills (language and experience wise) for which they created one position that I can do instead of two positions that they originally listed. They want to focus on that aspect to get the expedite that they only need to hire me instead of 2 people.

You can always make a request. However if you wish to be successful your reason should be more than just having a job offer. If you have a legitimate reason then thats fine otherwise wait like everyone else

I have a reason that qualifies under the 4 USCIS rules for an expedite...

 

Again, I am not looking for advice on how successful expedites are but rather if it is ok to share your receipt with a potential employer.

If you trust them enough to work for them and give them other personal information (ie name, dob, social) then you should feel comfortable giving them the receipt number for the EAD

The employer would be violating law by requesting any evidence of authorization to work prior to a job offer:

That said, they likely aren't familiar with the process. I have no idea why they want to see the receipt notice as there is absolutely nothing on there needed from them. Presumably their paralegal has handled employment-based immigration cases, which are different than family-based immigration.

Yes, yes, yes, please give them a copy of the receipt.

 

I don’t know what the big deal is. It is not her social, they can’t apply for a credit card in her name with the receipt number.

They’re not asking for evidence of work authorization. They’re asking for evidence of she applying for work authorization. One reason I could think of is to see how long she’s in the process to decide if they’re gonna wait for her or not. If she’s 6 months in, maybe they’ll make an offer tomorrow. If she just applied last week, maybe “bye bye”. Anyway I don’t think there is any ulterior motive here and it’s harmless to provide them that.
