Timeline

Can a K1  with a pending application to adjust status  and pending  employment authorization document  apply for a Texas driver’s license ? Can an individual present immigration documentation with an alien or I-94 number or Form I-797 indicating pending I-485 or pending application for adjustment of status to apply for a texas driver license? or do i need to wait until EAD which is taking long for a K1 to be approved ?

You'll have  to wait until EAD or GC Texas is very by the book. But some do get through. Don't get your hope's up though even a state ID  you'll have to wait for.

Yes it is very possible. They will however have to do a second verification on your i797c document which would take 2 weeks. After that is done, you'll be able to proceed with completing the Driver License application and will get your License which will be valid for 1 year. 

 

In my husband's case, he git his first drivers license using his i94 which was still valid and they gave him a license that expired the same day the i94 expired. So after its expiry, he went back with his i797c (pending AOS) and he got his drivers license renewed.

 

So it's possible. However you might meet some difficult DPS officers who might say you are not eligible, so it's advisable to go with the documents that allows people with pending AOS to get their drivers license.

The Real ID Act (of which Texas is very compliant) and the Texas DPS License guideline allows people with pending AOS to get a one year drivers license. My hubby got his drivers license with his i797c. The only issue is that they had to submit his document to DHS for second verification (DPS can't verify the document on their system) so there was a little delay of about 2 weeks.

 

I will post the documents here later that proves that people with pending AOS can get their drivers license in Texas.

These are the documents that confirms that people with pending AOS can get their Texas Drivers License with their NOA1 (i797c) document, international passport, social security, proof of residence, and other relevant documents.

they do not work in every DPS office. i went 3 times with basically a briefcase full of documents each time and they still refused my wife an ID card. i even brought the printout specifying that she should be eligible, but the supervisor nixed it.

Which Field Office is this? I recommend you guys go to the nearest Mega Center.

Even the Supervisor of a Mega Center is ignorant. This is quite unfortunate. Well I recommend you try another Field Office nearby if you have the time. You can also report the mega center to InspectorGeneral@dps.Texas.gov (or call (512) 424-5769) or you contact their Customer Service via this link: www.dps.texas.gov/contact.htm (or call (512) 424-2600). These guys need to get their act together.
