Hi everyone, 

i filled for adjustment of status last month and I think me and my wife filled the I-134 instead of the I-864 ( affidavit of support) since I’m adjusting from the us. 
please tell me what will happen and what should I do to fix this issue? 
ps: I already got the receipts number and have an appointment for biometrics this week .

File an I 864.

Same place you sent the I-485

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Well, the I-485 has been accepted, so you will not.  As long as you have the I-864 ready to go, and you meet the eligibility requirements, should not be any issue.

Thank you for your help, notice says case was received ( I-485 ) not accepted yet

Ah, okay.  I figured that if the forms had been rejected you wouldn't have gotten a biometrics appointment.

I forgot to submit an I-864 as well and got an RFE around a month after I had taken my biometrics. 

Thank you for your help, did that make any delay on your case ? And how long u waited to get your EAD after biometrics taken?

EAD normally takes about 6 months provided you don't get an RFE.  If you get an RFE (vs them requesting the I-864 at interview) then the EAD is stalled until they get what they need.

It's the I-864.  Keep your fingers crossed you wont get an RFE, but easy fix at least.

If you were to get an RFE, you would have to simply read the directions and respond to it that way.  If they do say use the I-864, and other supporting documents, you mail them with all the correspondence and USCIS will reply back to you saying if they accepted or not.

 

Or, the other way would be to call USCIS with your receipt number and tell them you accidentally mailed the I-134 instead of the I-864.
