Hello everyone, 

 

 

My partner and I are currently waiting for our NOA2 (expected to be approved by beginning of November). I'm going to US by the end of tNovember and I'll stay for 90 days (until February). I'm from Brazil so the embassy for the interview was set here, but If we receive the approval in November, can we change the interview location to New York?

No. There is no US Embassy in New York. By definition, US Embassies and Consulates are outside of the US.

As far as I know, you can only apply for the K-1 Visa at a U.S. Embassy or Consulate.

 

Where in New York are you thinking of interviewing at?

The whole point of a visa interview is to determine your suitability to travel to the USA. There are no American embassies inside the country. You have to be interviewed at the consulate responsible for your home land or the place where you currently live (if you no longer live in your home land). You won’t be living in New York before your visa interview. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

No.  It doesn't work like that.  You can't apply for a visa to enter the US from inside the US.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Maybe you should postpone your trip and get the visa and then move...If you are going for 3 months I guess it won't be an issue to move to the USA before Xmas if they approve your visa. The petition expires in 3 or 4 months after approval, so you are risking it to expire...

Also as other said there are no US embassies inside the US.

As others noted, there's nowhere to apply for a visa from within the US. You will interview abroad still.

Unusual for a tourist visa to get approved when there is a K1 application in the computer 

And even with an approved tourist visa,  when the customs sees a K1 application at the POE,  they can deny entry

you just applied August 8th so chances of interview happening before February are slim

plus, you are going to need the criminal report from Brazil for the interview (most expire in a few months so can't come with one)

 

What you suggest is the way immigration use to do this process but the job of interviews was given to the embassies

It use to be for War Brides and finances to come this way and be interviewed but the passing of a bill in 1970 Public Law 91-225 changed the way to allow for all fiance visas from all not just the war brides so things have changed and keep changing as immigration itself is changing

Likely already had tourist visa and people visit all the time. We have threads in both the IR1/CR1 and K1 forums regarding visiting.

There are ZERO U.S. embassies within the USA ....   by very nature of the purpose of an embassy
