Does “NJ Family care” comes under public charge?

Timeline

Hi everybody! Hope everything is good with you all.

 

I am pregnant and waiting for vawa approval. Mean while since I can’t afford the expenses of pregnancy i am thinking to apply for NJ Family care. Looking at what’s going on with public charge, will using NJ family care only for my pregnancy be considered a public charge? Will I be denied in future? 
 

please any advice would be appreciated.

NJ Family Care is a Medicaid and Emergency Medicaid expansion which immigrants under 18 and pregnant women are eligible to apply. Other immigrants must wait 5 years. Under those determinations the state of NJ does not consider it as a public charge under the old public charge rules, however be extremely cautious under the new definition of public charge. http://www.njfamilycare.org/imm_info.aspx Under the new definitions which are held up in court its possible the government could at some point look at it differently. However VAWA applicants don't fall under public charge determinations usually.

Its not 'usually' its always... Public charge concerns do not apply to VAWA self petitioners. They do not fill out the 864, they use the 864W. Also VAWA petitioners and subsequent GC holders are not subject to the 5 year rule to be eligible for assistance programs.
