Timeline

1. Part 3 .......Question 9. I am sponsoring the following family members immigrating at the same time or within six months of the principal immigrant named in Part 2 above. Do not include any relative listed on a separate visa petition.

I have a K-2 Daughter that came here with my Fiance ( wife now ) Should I list her in the space below question 9 and count her in the box asking for the number of immigrants I am sponsoring....... giving a number of 2 on question 10?

Or only count the K-2 on her own I-864?

2. Part 5 What is the correct way to fill in this section. There are 3 of us. Me......(the sponsor), my K-1 fiance ( wife ) and my K-2 daughter.

I'm sure this has been asked before. I've done a quick search but don't see it.

For Adjustment of Status:

My wife and son are K3/K4. How do I answer Part 3 of I-864?

Part 3

Check 8, 9, and Yes for 8.

Put daughter on line 9.a

Line 10 will be 2

21 c. don't count Spouce as spouse, she is counted as immigrant on line 21 a.

Thanks...........so does this work the same way when I do the daughters (K-2) I-864?

i.e. I will count the K-1 in Part 3 (I-864) .....check the box on # 9 and list the K-1 in the (a) box below?

Just a little bit more info please?

I am doing the K-2 I-864 now and in Part 5 ( c ) it says "If you are currently married enter your spouse."

Well.......I am married to the K-1. and she is listed in Part 3 giving be a total of 2 and entered in Part 5 --- 21 ( a ) along with the K-2 giving me a total of 2 on that line and with me a total of 3 for the household size.

So, the question is to leave ( c ) under part 5 as 0 ? And just count the K-1 from the # listed on line 10 of Part 3?

i.e. count 2... the K-1 and K-2 in line 21 (a) and forget about counting the spouse in Part 5- 21 ©

Hope this isn't too confusing.

5c Your spouse is counted as immigrant on this not spouse.

That is for situations like sponsoring a mother/father/sister/brother or even a child that immigrated later like 6 months later than spouse, then you would count Spouse as spouse, not immigrant.
