Sorry for the repost of a similar question I posted in another thread, but I wanted my topic title to be more clear, for more responses. Old Thread

If separating/divorcing before any AOS papers have been filed, and he is willing to go back to his country, is it really necessary to get any signatures, for instance on a legal separation? In my state we must be separated for 1 year before divorcing. So, he will just live in his own country during that time. I plan to consult with a lawyer, but thought I'd ask on here for anyone whose had to deal with this already. I know legal separations aren't necessary here.

This is really a question for a family lawyer. Is there such a thing as a contested divorce in your state? if so, then any agreement struck in advance with a person that might be difficult to contact a year hence, would be wise in my mind.
