Adopting A Niece that was abandoned

Hi everyone, was hoping we could get some guidance on this. Basically it’s a variation of adopting a niece question. Long story short, little girl was basically abandoned by her birth parents and left with the grandmother and her aunts to raise since birth. Father’s status is unknown and mother has since remarried and has no intention of taking her in since the new husband doesn’t know about her. In the meantime, her grandmother and her youngest daughter managed to get their green cards and move to the US. From what I understand, there is the possibility that the youngest daughter (her aunt) may qualify to adopt her niece since she has lived and taken care of her for a number of years and then petition for a daughter which would be faster then petitioning for a relative

If they can show that she has been caring for the child and have been abandoned (which looks like they can), then yes, they can adopt and petition of the child.

 

However (and this is a big however)... they need to be aware that the adoption process may take some time (years) to be complete. And the adopting parent can't start the process until the adoption is completed. So this is not going to be a fast process and they should plan accordingly to this fact. 

 

P.S. Adoption does not guarantee immigration benefits.
