Thank you everyone for your responses! I hope it is really nothing and happy that they didn't come earlier..who knows what could have happened.

 

After I posted this yesterday I asked my husband if they showed their IDs and he said all three of them showed their badges. 

Yes, they didn't look for any proof of our relationship but i guess the room with flowers and pink pencil case with colorful pens, and me still looking asleep with uncombed hair were enough? :)

And somehow they knew the car my husband owns (it was parked far from our apartment) and they said they saw our dog looking out of the window couple of days ago. Were they watching us all this time?🤯 

 

I agree that it is actually one more reason to file for AOS within 90 days  of I94. And getting SSN and medical insurance as soon as K1 visa holders enter US. 

I wasn't able to get one of the shots at my home country so I was planning to get it here before filing. But I got sick after our wedding day (all that interview and moving to US stress) and struggled with not being able to join my husband's insurance without SSN (somehow USPS returned it back to SS Office and they sent it back after we called them after 3 weeks of waiting). It took us a lot of visits to urgent care and money to try to figure out what was happening with me. And I really needed a visit to Primary Care Manager whom I was able to see only after I got SS card, joined my husband's insurance. And still had to wait A MONTH for an appointment explaining it as I am a new patient. I don't know how I survived that time. But 3 months later I finally felt better and was able to get my shot for I693 and to send out AOS package. 

I hope nothing like this will happen to the ones who is waiting for their visas, but this was my lesson and I hope it will help someone.

I'm sorry that happened to you.

 

Just one thing. You were not required to send I-693 with the AOS, so you could've sent the AOS package just after getting married, and later, when done with medical, mail out I-693 (or even wait for the interview).

I am sorry to say that you will find out immigration is not the only thing you will feel is unfair

most of us have fought with major companies (mostly on hold a long time) 

try just one time to straighten out a wrong bill and cancel a utility 

it gets to be a lot of fun 

seems service in the US is about the worse compared to other countries

The other aspect of it (and it is not common to see on this site since this VJ is more of a FB oriented site), is that USCIS also conduct routine checks on EB workers (H1B, L1 and H2B) specifically because frauds were at one point very prevalent in those type of cases (bodyshop IT consultant businesses, ... ). I think that what started the  Administrative Site Visit and Verification Program as mentioned above to check on H1B work sites and then they started to branch out  to different type visas.

They asked if we filed I485, because my visa is expired. So I just showed them the whole folder of all forms I filled out for my AOS package on laptop and receipt from UPS that has the address of Chicago Lockbox with a date on it. They took a picture of it. And one of them was making notices on his paper. They didn't check anything else inside the apartment, were friendly and had casual talk with my husband and then left. Oh and they said they are checking us because I am from Uzbekistan. I didnt know it is considered as high fraud country🤷‍♀️

 

That was so unexpected that I've just started realizing that it could be something serious. Is there anything to be worried about?

So I have a question. If we have 90 days to get married how does that play into when you have to file for the AOS? What if we got married a few days before the 90 days is up. How long does that give us to file the AOS and not be out of status? Does the AOS have to be filed 90 days after he enter the US. I'm confused.

Once your I-94 has expired (90 days after entry into the US), you are out of status and subject to deportation.....as is any non-immigrant..  Only when you file the I-485 do you have "authorized stay" (not a legal status) in the US until the I-485 is adjudicated..Thus, it is highly advised to marry AND file for Adjustment of Status within the 90 days. There are no benefits in delaying filing for Adjustment of Status.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

FYI   your K1 visa expired the moment you entered the USA  / it is a one time entry visa

I see more people are using the OP' story as an incentive to file AOS right away. TBH, the AOS should have been planned and saved for before the beneficiary stepped foot in the US. It is a critical part of the immigration process. Too many times we have seen people tell us that 1 or 2 years have passed and they still have not file for AOS. And it is mostly due to cost.

 

I know it may be harder for some people to do but that $1200 for AOS should be already allocated when the K1 is approved. There are so many changes occurring in immigration that being in limbo  like that is only adding stress and anxiety to an already stressful situation.

 

A small tip: If finances are an issue, the day you send off the I-129 is the same day a person should start putting away a few bucks here and there to go towards paying for AOS.

there are 7 different divisions of DHS

1 is airport security

another is ICE that would show up at work sites / usually poor paying job sites that often hire illegals 

FDNS is another / they make unannounced home visits but this can also be done by a DHS or FBI officer

border agents are a 4th 

and the DHS security guy i talked to did not tell me the other 3 but said there are 7
