Hey everyone. My Pd is June 30th’ 2017 and my case is filed under f2a for spouse visa by my husband. We’re on nvc stage atm, what do I need to know is that my husband’s this year income is around $31,000 is that enough? Also, he joined this job 2018s summer (June) but his last year pay with this job was around $24000, what should we do now? Should we submit his this year’s paystubs along with employers letter? Do we need to submit any other documents too? We are going to submit his brother’s paystubs too as a backup. Do we necessarily need to submit; IRS, w2 and 1040? Please someone make a proper list for me!! Thank you in advance

Hello:

I will try my best to answer you question.  But for community sake please fill out your timeline so visa journey has accurate for others in the same position as you.

 

Per HHS Guidelines to file I-864 (Affidavit of Support)  your husband income is sufficient to support you in the US. If its just the 2 of you. please see the link below for confirmation.

The I-864 requires the sponsor's most recent tax year's copy (IRS transcript is simplest) + evidence of current income.

If they are a W-2 worker, then an employment letter + paystubs would show current income.

Assets are optional. Any assets listed need to show evidence of their current value and ownership, and not put a burden on the sponsor.

 

If the brother is a joint sponsor, they need to provide their own I-864 packet as well, plus evidence of being a USC or LPR.

Joint sponsors cannot combine income with another sponsor. They have their own houehold size as well.

 

If the brother lives in the save residence, they can be added as a household member instead of a joint sponsor. This lets them combine income/assets with the sponsor.

 

It's impossible for anybody to say if $31k/year is sufficient. The CO looks at a totality of the circumstances. It meets the minimum for consideration, but otherwise it's a judgement call.

Oh thanks so much!! His recent taxes must be from 2018, cuz we haven’t got his 2019 tax return yet. Yes they live in same residence. What do we need to combine his income in my husband’s?

He includes the brother's info/income on his I-864, then the brother files an I-8646A as a household member to join incomes.

We don’t have 2019 tax return on our hands atm. What do we do now? Also, his brother joined his last job 4

months ago, would 4 months stubs be enough?

Nobody has a 2019 tax return yet. haha The 2018 returns are the latest anybody could have.

A person with expired greencard can be your joint sponsor?

Technically yes (the green card is only evidence of status, not status itself) , although I'm unsure if they would accept the green card if it is expired, sorry. I'd suggest that they resolve the expired card first, if possible.
