I am the petitioner. My spouse beneficiary lives abroad. Her primary address is with her parents in Kandy, Sri-Lanka. However, she only comes home for the weekend. She will be working for the next 6 months in Colombo, Sri-Lanka. (She is expected to resign in 6 months and will no longer be living in that address in 6 months from now).

My question is, in I-130a, do I add both addresses and mark them both as "PRESENT" for my wife ?

I’d put her parents only, the I130 will not be approved in under 6 months....

my my husband has the same issue as petitioner... he resides in one state, but spends 99% his time in another with work... we had no issues

I'm filling out the I-130 and here's how it look after printing (attached image). The first letter cuts too tight to the left border. But it's readable. Is this okay ?

Simply needs to be legible

YMMV

I'm going to attach all the forms punched on the top using a two holed puncher and fastened by a paper fastener.

However, I have also stapled the related items together in groups (I-130 Form, Birth Certificate and Copies, Passport, etc). Is that okay ? I figured stapling the items that belong together would be safer. Would this cause any issues ?

No, don’t staple anything. Use paper clips only. The first thing that’ll happen when your petition get to USCIS is that will need to scan/ make copies and stapling will make their job harder. Then they will arrange you file into their preferred order. From what I’m told, every file has two parts: what you submitted and what they find out on their own through background and what not.

Hi, I'm the petitioner for my wife abroad. I'm running into some confusion regarding my wife's name. (I'm using a psuedo name here for privacy reasons).

  • In her birth certificate: Amra Asif
  • In her Passport and Drivers License: Kandeyan Fathima Amra Asif
  • Social Media / Most people recognize her: Amra Asif

In the I-130 Petition this is how I entered her name. This seems correct from what we discussed.

  • Family Name: Asif
  • First Name: Kandeyan
  • Middle Name: Fathima Amra

My question is, Do i need to include "Amra Asif" as a name in the "Other Names" section of the I-130a ?

Yes because that's her legal name. When they ask other names they are talking about legal names. Like for women our birth name, married name.
So her Birth Certificate and Passport names were her legal names. So you would list Amra Asif.

Many recommend using a two whole puncher to punch the top of the documents use fasteners to tie them together. I'm concerned whether USCIS will consider certain documents invalid if the puncher hole cut through certain items. For instance,

1. The puncher hole cuts through the border of the copy of my naturalization certificate

2. The puncher hole cuts through a small section on the top of my original birth certificate photocopy

None of this of course makes the document impossible to read and understand. However, I'm concerned they will deem it invalid.

What are your thoughts ? I would definitely prefer to use the puncher and tie them together because it's a thick application!

Posted (edited)

We did not use a whole puncher and a fastener.

We used a big binder clip. It held the documents together very securely.

We also used paper clips to attach passport photos to a piece of paper.

EDIT:

How big is your application? Ours was also quite big and thick but a big binder clip did the trick.

Edit again:

WOW that rhymed. 😎

Then don't bother punching them.  Let them scan the whole pages in before they punch them.

We didnt punch them either. We used paperclips to group some of the documents, marked them with a small post it note at the bottom according to the cover letter, and put the whole package in a see trough sheet protector with a clip to hold it all together. Wasnt sure if the distance of the two holes is aligned globally, and didnt want to give them a wrongly punched application.
