Public Charge Implementation by DOS and UK Embassy?

Timeline

I haven't completed my timeline yet, but our K-1 petition will finally be going out next week. Pending approval, we're trying to prepare for interview stage. With the implemenation of the public charge ruling by the DOS (the injunction only blocks USCIS not DOS), does anyone have any idea how that affects UK Visa's?

 

The only thing I'm really concerned about is the wording on the ruling makes it seem like they are basing the income on the beneficiary and not the Sponsor, it makes it seem like the 125% needs to be presented by the beneficary. Also, formal education seems to be a positive factor, but are UK citizens really on the radar if they don't have a university degree?

So officially, they have to treat everyone the same... unofficially and based on what I've seen and read I've always got the impression that certain countries tend to get an easier time of things.

 

I just had my interview earlier today and there was no mention of any of that. The only time they really asked about my degree, education and employment was on the DS-260.

There are additional criteria they look at in evaluating the totality of circumstances, but overall it’s the same process. A suitable sponsor is fine still so long as the applicant is not likely to become a public charge.

 

It’s impossible to say how exactly this will be evaluated by any COs at this time. Even with the UK, who historically have been pretty lax with the public charge issue especially for K-1 applicants, the policy just went into effect so there’s no way to know how they will respond yet.
