Arrest after receiving police certificate

trying to get you to understand that once is probably ok but if you keep on dismissing it as a “mistake” “not serious” “morality doesn’t matter” etc that implies you don’t seem to understand the risk that will come with repeating it - which is often what happens when people don’t treat offenses like this seriously. It’s nothing to do with emotions, it’s about understanding that things take on a different turn when immigration is involved. I understand you’re defensive about your wife, but you need to see the bigger picture.

I would get a new police certificate. 

 

Wait until the blood sample comes back and then go from there ....

16 May 2020: Received NVC email, paid all fees. Waiting for fees to process so we can upload and submit all documents

19 May 2020: Immigrant visa Fees PROCESSED; affidavit of support fee PROCESSED 

28 May 2020: Submitted VISA application, civil documents & affidavit of support documents. Patiently awaiting DQ. 

2 June 2020: Email received from NVC stating that we have been Documentary Qualified and that they will liaise with US Consulate in Sydney for Interview 🐨

27 June 2020: Expedite request submitted 🤞

7 July 2020: Expedite request APPROVED! 😃😭

15 July 2020: Email received advising of interview date and time. 
20 July 2020: Medical i: n Melbourne CBD 🏥     
28 July 2020: US visa interview at US consulate Sydney - refused 221(g) issued. Request for joint sponsor 😞

31 July 2020: uploaded joint sponsor to NVC, emailed consulate 

5 August 2020: emailed received advising they have received the joint sponsor 

7 August 2020: case i0n “administrative processing” 🤞

10 August 2020: visa ISSUED 😭 

12 August 2020: passport and visa in hand!

How would you like to be hit from the side from a drunk driver and than fly from the passenger side and crush the driver aka my best friend at the time. 
I was in traction for two years and passed out from a serious concussion for years. 
I was twenty one and the driver took off as he left the scene with injury and death.  
I thankfully was able to pick him out of a line up from pictures they showed me in the hospital.  
The US gave him 10 years in prison but it’s nothing compared to taking a life and what it did to mine. 
 

The fact you are not taking it serious and looking for ways to not bring this up has hit a nerve with me as well so please forgive me. 

The fact was she did not take a taxi. 

So Yes, be honest unlike the driver that hit me. 

Accept the delay if there is one. 

 

We had to redo the DS 160 a week before the interview and had a child added. 

Not that hard and may delay your process but sure beats her sitting in jail for ten years or lying to immigration by not reporting any changes and the US finding out later. 
 

Trust me this could have been worse than updating information at your interview. 
 

Good luck on your journey and I do hope that she will think twice before getting behind a wheel to drive.

I understand where you're coming from and all, but this is a forum about immigration. This isn't a forum where you go around to pass judgements or condescend people. What I see this as is beside the point, I'd appreciate just being professional and staying on topic. I never asked for you to make me realize the ”bigger picture”.

I don't know why everyone is assuming she was actually intending to drive. Honestly I'm really really sorry what happened to you, that's terrible and people shouldn't be able to get away with it. Thanks for the advice, you're very kind.

Because no other details were given---not that you have to----but if she was charged, it's natural to assume she was at least sitting behind the wheel of the car at that time.  No one here knows what she intended to do...not even you, really, unless you were able to read her mind at that moment of her intoxication (and we all know people don't always use the best judgement when intoxicated as to what intentions they may/may not have).

 

I am curious, though, since she wasn't actually intending to drive (as you say), how the police happened to come across her.

You are explaining these circumstances to us, here, as if we are the ones who will be making the decision. The facts are that if you file your application with a police certificate and they find out (which they will) that you filed it knowing it was incorrect and not up to date, your application will probably get denied. That's it. Why argue? Waiting for a new certificate will delay you a little, and waiting for the outcome of a pending case will cause a longer delay, but these are both better than risking a denial. The good people on this forum are not making the rules, just providing the advice you asked for. Best of luck to you.

She doesn't drink at all often, other than on special occasions. This special occasion was her sisters birthday. We had parked in a car park in the center of town so we can enjoy ourselves at a restaurant we had reserved, originally we were going to go to a movie afterwards and wasn't planning on drinking much if at all. We had a couple of cocktails at the restaurant and that got us excited so we went to a pub for some more drinks. Terrible mistake on all of us... By the end of the night we were of course drunk out of our minds and no way she could drive, we planned on leaving the car there in the carpark and call for a taxi or to call her dad to come pick us up. We had went to get mcdonalds and went to the car so we could sit and eat, listen to music, while we wait to sober up a bit before calling a ride. I guess somebody saw us stumbling around outside of mcdonalds and so they called the police, that is what the arresting officer told us. 

 

That's the whole story for anybody whose curious. On the breathalyser she blew over 130, there is no way she would even begin driving out of that lot. 

 

We have done this once before where we just left the car and got a ride home. If I wasn't as ignorant to the law I wouldn't of ever taken the risk. Anyways I'm sorry for the confusion, maybe it makes it easier knowing the whole situation. I do not at ALL condone drinking and driving, I promise you that.

I know, I'm desperate from the long wait and that shades my judgment. I'm going to go about it the right way no matter what, I'm consulting a lawyer to make sure everything is done right. Thank you for the feedback!

Thank you for sharing...although, again, you didn't have to.

 

Luckily it's a minor delay immigration-wise while it gets sorted out.

 

The silver lining, I suppose---and it's quite a bright silver lining looking at it from the outside---is that someone who felt you/she/one of your party had the intention of driving drunk stepped up and phoned the police.  If you were drunk out of your minds, as you said, god forbid that one of you HAD decided off-the-cuff later on "hey, I'm good enough to drive!" and you ended up killing yourselves or someone else on the road that night.

 

Perhaps it was someone being nosy/causing you problems now by calling,...and perhaps it was someone who ended up saving someone's life that evening.
