Timeline

My fiance submitted her additional docs May 29 at a local VFS office in India, along with her passport. They told her to call back in 5 days to get the passport. The additional docs they asked for were:

Ration cards/Voter ID/Voting Lists.

Nothing else.

I called a Fiance Visa expert(lawyers) in CA. They said that since she got a 221g it means that they are questioning our relationship. I dont know why they would ask for this information. I already submitted the usual(photos, hundreds of emails and tickets and phone bills). So he says now that they will either issue it or not and they wont ask for any more info(totally opposite of what the experience of alot of people on this board).

At this point we are not sure what to do. The Indian consulate has suddenly become stringent in Delhi. The lawyer said we should try to go for a K3 now. Anyone have any advice?

K1 Visa Timeline :

07-27-2007- Sent out I-129f

08-07-2007 : Received NOA1

12-23-2007 : NOA2 approved

12-27-2007 : NVC Received

01-10-2008 : Case forwarded to New Delhi Embassy by NVC.

01-14-2008 : New Delhi Embassy received our file from NVC.

01-24-2008 : Submitted Packet 3 at New Delhi Embassy.

02-06-2008 : Submitted docs at VFS.

02-21-2008 : Interview- visa was approved pending security.

02-25-2008 : Called NVC and they said Visa is approved. VFS- they didnt get it yet.

02-27-2008: Visa in HAND!!!!

03-08-2007: Arrived at POE(JFK)

May 12-2008- Got the Marriage License

May 19-2008- Married!!!

06-06-2008 Mailed out AOS

06-08-2008 Delivered to Lockbox

06-16-2008 NOA for EAD, AP, AOS(dated June 12)

I was just told that by getting a congressman involved it will "upset" the consulate and they will screw up the case even more. They dont like to deal with Congressman. Is this true?

First off, I'd say consult with an attorney that has experience in K1 or K3 visa's... the one you spoke doesn't seek to have any. Be patient, it's been a little more than the 5 days that your fiance was to get the visa, maybe its on the way or soon will be. If you dont get mid next week, I'd say to either call the consulate in Dehli to see what's going on. The congressmen help I think is a good thing, its makes you look all important that these gov't folks are inquiring on your case. I say do it.

The reason that attorney told you to do the K3, is to milk you for all the $$$ you got :) It would be a new process, new money for him. Be patient and it will work out on the K1. :thumbs:

A 221g does not automatically mean they are questioning your relationship. It can be as simple as requestng missing documents as they have indicated.

Timeline

You should never be made to feel afraid to contact your representative for help. Call your congressman/woman (find out who and where at www.house.gov - enter your zip code and then find the district office - that's the office in your state, probably near your hometown) and call and ask to speak with whomever handles immigration casework. Explain your whole problem and timeline, have dates and case numbers handy. You can also call your senator (www.senate.gov).

Congressional/Senate offices have much better luck working with the State Department than with USCIS/DHS.

If your lawyer is the one saying not to contact Congress for help, fire him/her at once. Do you know who the lawyer calls on your behalf? The immigration case worker in the appropriate congressional office. There's no other magic phone number lawyers get to call to find out information.

1-23-07 NOA1 Notice Date

1-26-07 NOA1 arrives in the post

7-16-07 Visa delivered after 'security checks' completed

A 221g does not automatically mean they are questioning your relationship. It can be as simple as requestng missing documents as they have indicated.

Its just bad luck... why are they asking for these additional docs... it is a stressful situatio... but I will be patient and hope for the best.

That is better answered by others who have used the consulate but, if my memory serves me correctly, you are not the first who has received this request and maybe it is becoming the new standard....

Hang in there, this is tough to go through. Who's ration cards are they asking for? If they are just asking for your fiancee and perhaps her immediate family, then my guess is you are fine. If they start asking for full detailed information of each of your relatives (cousins, grandparents, nieces, nephews, etc.) then I would be more concerned. The reason is from what I have read so far, that is a common request Delhi makes before issuing a statement like your petition is too old (more than 4 months) and they chose not to extend it, so it is being returned to USCIS, or that you failed to demonstrate a qualified relationship under 221g.

Get the information they request ASAP, and try to email the consulate ivnd@state.gov or give them a call. Make sure you are respectful and calm. Make sure you are aware of your I-129F petition expiration date (should be listed on the I-797 approval for I-129F (NOA2)) and contact the consulate about having them extend it. Also, look back through your application and evidience provided to VFS. You might want to contact VFS as well to see if they can give you any tips. Also, visit the South Asian regional forum, there are a few posts by people who have received 221g from Delhi.

They are asking for my fiances ration cards. I am hearing it is used for proof of identity. She was at the interview May 23 and submitted it all May 29(memorial day it was closed). She sent it along with her passport.

So just to be clear, they are asking for this from my fiance and then will say the petition is too old? Or are you saying that if they ask for detailed info about my relatives then that means the petition is too old. they have not asked anything from me at all. Never did. the whole approval took less than a month in the US.
