Employment letter for AOS Application

My husband and I got married a month ago and we are almost ready to send out our AOS packet.I met the required income requirements and included a copy of my bank letter,statements and as well as six months of paystubs from both of my full time and part time jobs with our packet.Is employment verification letter still necessary for our AOS application?The reason I asked is because our HR is taking a VERY long time to provide me a copy of my employment letter. We're supposed to be a May filer but that didn't happened due to the delay on my employment letter.

No, it is not necessary. The only necessary item that goes along with the I-864 is the latest 1040 + W2s etc or latest tax transcript. All other evidence of job/pay is optional.

Yes, it is important. If you don't include it in your AOS application, you may get an RFE telling you to send it in. My RFE was for the I-864 and on the notice, it said you should include employment letters in your application.

My wife sent the employment letter too, and we did not get any RFEs. But my perception is that it is like a lottery, if you are lucky, you will not need the paper, if not, maybe you will. so my suggestion is to send it as much as you can, if HR is taking longer than usual just send the paper as you have them (at least try to get "equal" value documentation)

As you can see on the first link they ask for

"~ Evidence of current employment or self-employment, such as a recent pay statement, or a statement from your employer on business stationery, showing beginning date of employment, type of work performed, and salary or wages paid. You must also provide evidence of current employment for any person whose income is used to qualify."

Also, there are a couple of checklists in the rules. follow them and you will be good to go! :)

Yes, it is important. If you don't include it in your AOS application, you may get an RFE telling you to send it in. My RFE was for the I-864 and on the notice, it said you should include employment letters in your application.

And yet the instructions for the I-864 say it is optional.

It is a ####### shoot I'll admit, I personally only submitted my last 1040+W2, and got no RFE. My impression is that when they changed the rules about 9-12 months ago, a lot of people got RFEs because not everyone was following the new rules. I believe now they only tend to ask for more evidence if your taxes show you're earnings are marginal. Of course it depends on the USCIS officer.

My personal advice is to include it if you have it, but don't hold up your AOS application waiting for it.

We sent a copy with our AOS paperwork. Actually, it was the same letter I presented at my husband's interview for the K1 visa (not too long ago).

The problem w/ USCIS is that some people receive RFEs for something that someone else did not send and had no problem.

Exs: The vaccine supplement I-693A, letter of employment, tax returns for more than one year...etc.

It sucks :angry:

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

I guess so cause I just sent in what they asked for the only deviation was that I sent tax transcripts for 2005 and his W-2 and efile for 2006. No statements or pay stubs or other work things... No issue here... so, I would agree that if you don't get the letter from HR on Monday send your paperwork in with what you have. Good luck with your journey,

The employment letter is not compulsory since you have paystubs but it is better to have.

The employment letter is not compulsory, pay stubs are not compulsory. Only the last submitted tax return is compulsory.
