K1 visa interview, is there any hope?

Your only option is if your relationship with your fiancee is real, get married in Nigeria, give it more facetime together with your new wife and then file for CR1.. Best of luck

Well you can only apply for a CR1 once you've married. So the next step would be to get married

Your timeline is too close to each other like @Teetop said because I'm sure the CO didn't denied it because you don't have a proof of wedding reservations, I was asked the same question and I told them we doing just court wedding, big wedding later. I was also asked about previous B1/B2 visa.

Is this is good sign ? All supporting documents wasn’t returned to me . My divorce certificate, affidavit of support and Joint sponsor, police certificate and medicals etc

In your case, no.  The case is being returned to USCIS where it will die.........your K-1 is dead.  It's time to regroup, formulate a new plan, and execute it......

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Can't think of too many couples that file for divorce in 2017, and then afterward plan a tourism trip together in 2018...especially if one of the parties is all of a sudden engaged to someone else in the meantime.

 

CO probably thought that seemed somewhat fishy.

No.  They tend to keep stuff like that on file for cases that are returned to USCIS later on, anyhow.

The letter you received also tells you it's denied.

You planned to travel with your ex-wife in the middle of a divorce? What was the reason for the travel? Usually, couples in the middle of a divorce are not that cordial to want to travel together.

 

The CO probably felt things did not add up. You will need plenty of evidence when you file the CR1 to remove that doubt.

Divorces can take a long time to finalize.

 

Usually a divorce decree states somewhere at which point the couple ceased living together. My final divorce decree was not too far from the time I met my now fiance. But in my divorce paperwork, it indicates the ex-spouse and I hadn't lived together for at least two years.

How did you met your fiancé? Online or in person?

 

This seems to be your timeline:

married 2012

apply for divorce -2017

applied for visa to us with wife to attend real estate conference - early 2018

met fiancé - 2018

divorce final 2018

k1 visa - after divorce is final

Add in that the OP and his ex-wife were planning on visiting the USA where the OP's new fiance lives?  Would have also raised suspicion with the CO.

 

Perhaps the CO thought that the divorce was done only to obtain benefits with the USC fiance, quick US divorce, and then "remarry" the first wife and bring her over later on...unfortunately some people try to do this.

It's a bit different in your case, though.  Seems the relationship beginning with the new fiancee overlapped the divorce proceedings in the OP's case.  And then there's the part of the OP and ex-wife (before the divorce was finalized) filing for tourist visas to travel to the US together after OP becoming engaged again.

We were not cordial, I was visiting my son and she heard about it ,meanwhile we were hoping things would work out

I know how  you must be feeling now but take few days to  relax and start thinking ahead . If you had stated your timeline between the  previous visa application,  your  divorce and then the current I-129F petition ,I am pretty sure lots of suggestions base on experiences would have been offered here. Hence, always try to tell all here to avoid this kind of outcome in the future as I don't think most of us giving suggestions now had or is having 100% smooth sail in our past or ongoing respective applications.There will be delays and few hurdles down the road and using someone else's experience/mistakes to perfect yours is why we are here, I believe .They don't just deny  I-129F petition in Lagos without a compelling reason and as I  have read your posts today (not before your interview), you had few red flags my friend.

 

*Like most people have suggested, marriage in Nigeria is your best bet.

 

*Document every step you take with photos and receipts .

 

*My suggestion is you should go for holiday in Benin Republic and Togo together by bus ( it's cheap) ,just few days. With that, you have your names printed on  bus tickets and you have your passports' stamps to show for it together. If you live in Lagos, Lekki conservation center , Fela Museum and Olumo rock in Abeokuta are good spots to visit together and it cost almost nothing.Don't forget the use phones that automatically records dates, time and location.It sounds trivial but it helps a lot and by now you should know they take not of  timelines, which is very normal.

 

*Do these before the marriage and also make sure your marriage takes place at Federal marriage registry, Ikoyi for more validation. They also know Nigerians don't stop at just marriage registry , document your church/mosque/ traditional reception and the party.

 

*I-130 petition takes between 8-12months in Nigeria  after marriage.I know that seems to be a long wait but I promise you, it's not my friend, as long as you dot your  I's and cross your T's accordingly.

 

I will stop here but always seek for guidance here whenever you are lost.
