I'm not an expert on this because I'm just in the process of my fiancee probably getting her SSN denied for the same reasons, but I understand that when that happens SSA will give her a letter saying "We're refusing you card" and that this denial letter may have some value and can be shown to banks, health insurers, etc. along with her new NOA1 after we adjust status to rebut the idea that she is eligible for a SSN.

My health insurer has enrolled her without a SSN I just have to upload documents showing her lawful status.  For now, that's the I-94, and soon it will be the new I-797 I we expect to receive in about two weeks.

Yeah, I've been able to speak to BCBS and they've accepted the refusal letter from the SSA.

Took 21 days for my payment to process, then next day got all the case numbers via text and email, hard copies about 5 days later.

Same here. Waiting 3+ weeks seems to be the norm anymore with Chicago lock box

Final decision on the expedite: No

Longer blurb of info on their explanation:

Quote

USCIS provides applicant information for approved I-129F petitions to the Department of State's National Visa Center for issuance of the applicable visa. After review, USCIS has determined that the information sent to the Department of State was correct and as such this case is ineligible for expedited processing due to Clear USCIS Error.

However, this morning (the day after the call with the above response), I got a notification saying my interview has been scheduled!

Paging @yuna628:

Did they officially deny your ITIN request?

I would like an answer to this if anybody has one. I'm in a similar situation trying get my wife's taxes (USC, W2, should be easy) filed, but I have an SSN that I've lost and the SSA won't give me a new one because I'm currently out of status. By the letter, I don't qualify for an ITIN and my wife can't file her taxes without me having either an SSN or an ITIN on the return. I called H&R Block, but they said they'd have to get back to me in a few days after researching the solution. I'm trying to get my I-485 in before the new rules kick in so I'm really looking for some advice on this if anybody has any.

If you were previously issued an SSN by the SSA, then you should be able to get a replacement SSN card (or get the SSN itself provided to you at the SSA). I did have issues which resulted in the SSA running out of time to originally issue me an SSN as my I-94 expired.

If you were not previously issued an SSN, then their statement is correct. As you're out of status, you would be ineligible to apply for an SSN until you get a work permit / your green card, but you would be eligible to apply for an ITIN in the interim. (You may need a letter from the SSN saying you're ineligible for one)

I was previously issued an SSN, but the SSA refused to send me a replacement SSN due to my status. I went to the office and they still said they couldn't do it.
