Revocable divorce in egypt

Timeline

Every divorce in islam is revocable up to 3 times. Every country has different laws and USCIS should know that. As long as he didn't reinstate the marriage then he should be 100% divorced.

Yeah the reciprocity table even states:

Procedure for Obtaining: Once the divorce has been registered, the husband, wife, or lawyer representing either the husband or wife can go in person to the local CSO office to obtain a certificate or “electronic copy” of the certificate from CSO.

OP your best bet is to find a lawyer that you can trust. Maybe contact friends and family who are in Egypt and try and work those contacts to find a lawyer you can trust. It's not like they will be doing much "legal" work so I don't see how hard it could be for even an average lawyer to get this done.

Divorce documents must say final they may even accept irrevocable.  They won't accept revocable.  

 

Unfortunately he will have to get the final documents.  Hopefully he finds a way to get them soon!

Worse news is that if the divorce is not accepted as valid neither is the marriage.  That’s a bigger problem. A final decree can’t be backdated.

Can we provide other types of proof that his previous marriage is over?

I went through this mess with my former husband in Egypt year ago,    He needs his divorce to say IRREVOCABLE,  USCIS will only accept a Irrevocable divorce.   Then USCIS will also want the cert from the Family Civil Office to show the IRREVOCABLE divorce was registered.       If you have any questions, let me know.

Did he get his criminal report from Egypt when he returned?   It will be needed at the NVC stage of the process

if not there is more reason to return and get the divorce registered

And I have a good name of a lawyer in Cairo that helped me get the divorce registered with the Family Civil Office there, and got me 3 original certificates showing the marriage & divorce was registered. His price was fair, he got the docs we needed in 1 day .

USCIS don't see it this way,   only one case was successful, they ended up going to court with USCIS on this, the petitioner finally won after months and months.

Can you send me the name of ur lawyer? He’s getting his final divorce from the Egyptian embassy in England and we will remarry in England. Seems like the easiest thing to do. I wonder if the same process still applies since he doesn’t live in egypt. Thanks

He needs his criminal record from England since that’s where he’s been living the past 4 years. He’ll work on that.

Yes I will, but it will be when I get home from work at 6pm    

The Lawyer speaks Arabic and very good English too.   My husband dealt with the Egyptian lawyer, he said he was a good guy who did what he said he was going to do.

Needed is a report from all countries lived in for 6 months

Your welcome,   If you notice under my signature, it shows we were issue a NOID, its cause USCIS wanted to see the certificate that the Irrevocable divorce was registered in Egypt.

So you MUST get that certificate from Egypt

Timeline

In Islamic court there is a 3 month cooling off period before the divorce becomes irrevocable. If you are past the 3 months mark, you should be good to go.

 

The reason I know this is because I married my husband in an Islamic court and I was previously divorced.
