Timeline

I am sending in my wife's and my step-sons AOS documents today,

 

I want to verify what i have for the k2 (4 years old)

 

I-1485

Cover letter

G-1145 (E-verivication of acceptance)

Copy of passport with visa and entry stamp

I94 record

Birth certificate with translated  copy (certified)

copy of my wifes and my marriage certificate

2 passport fotos

COPY of the affidavit sent with my wifes AOS.

 

(I693 vaccine portion is being sent at a later date)

NOTE: Black & Bold = Visa Related

 

02/16/2018: Met online on a mobile game called Guns of Glory

10/03/2018: I129f sent

10/05/2018: NOA1

02/26/2019: NOA2 

03/19/2019: NVC received

03/22/2019: NVC case # assigned

04/02/2019: Consulate received

08/21/2019: Medical - passed on vaccines so insurance can be used in the USA.

08/22/2019: ASC

08/27/2019: Interview -APPROVED!!!

09/11/2019: Entered USA through Chicago O'hare

09/20/2019: Married

10/09/2019: Filed AOS

11/12/2019: Biometric appointment

12/13/2019: RFE (birth certificate)

 

 

Total time spent together before K1 interview: 65 days.

They will need their own I864 filed by the original sponsor in the K2's  name, not a copy of the K1s.

 

Are you not filing I765 and I131?

Filing an I765 is the only way you can get a K2 an SSN until they are granted a GC and youll want an SSN for them to file your taxes this year.....

In particular, regarding the I-864 Affidavit of Support, here is a portion:

 I-864 - Affidavit of Support: K-2's don't require their own separate I-864 with supporting documents (tax returns, etc). Make sure they are listed in section 9 of the K-1's I-864,** and provide a photocopy of the K-1's I-864 with the K2's paperwork. You don't need to include copies of the supporting documents with the K-2's paperwork.

**Bear in mind, that the Form I-864 has been updated/changed and the Guide has not been amended, the info for the K2 should be inserted in Part 3.

 

We successfully used this process for my wife (K1) and stepson (K2) for their AOS processing.

yes, we will be filing those with the i485s if they can all fit into the same envelope lol.. so many documents.

or needs a completely seperste affidavit with him as principal applicant?

The K2 will need to be included as a dependent/derivative on the K1's I864 and then youll need a seperate I864 for the K2.

I respectfully beg to differ, based up actual successful personal experience with this procedure. 

 

When I was preparing my family's (K1 & K2) AOS/EAD/AP applications. I carefully followed the VJ K2 Tip Guide as it relates to the I-864 as I previously stated in my first posting on this thread. I made a copy of my K1 wife's I-864 and included it in my stepson's AOS applications packet (as per VJ K2 Tip Guide). A subsequent change in the Form I-864 now requires a change in where the K2 is listed on the K1's I-864, and I previously described where that information should now be inserted in the current Form I-864.

 

Last night, I checked my scanned electronic copy of those submitted applications and that is indeed how I prepared them and send them to USCIS. My family got their EAD/AP combo cards and after the interview, their 2-year conditional GCs, with no RFEs.

the affidavit asks in part 3 question 29, "enter total amount of immigrants being sponsored in this affidavit wich includes the immigrant in part. 2 and any other immigrants listed in part 3 items 1-28"

 

I sent in 1 affidavit, with my wife as principal applicant and her son listed in part 3.  then a copy of the affidavit in with the k2 aos and a cover letter refering to the principal applicants affidavit for evidence.  i will let you know if it is rejected/rfe/denied

Sounds like you followed the format as described in the VJ K2 Tip Sheet. That's the method that we used for our successful K1/K2 AOS/EAD/AP submissions. How about letting us know if it was accepted too? 🤔 Trouble is that at the glacial pace that USCIS is adjudicating apps at this time, you may have to remind us of the issue sometime next year. 🗓️ 

 

Looks like you are trying to get it submitted before the 10/15/2019 form change deadline. That's a good idea, anytime there is a change in, or new, forms it is better to let the adjudicators get familiar with someone else's applications. 👍
