The requirement is to get married within 90 days,  if you do that then why would it be a problem?

The expiration date on the K1 visa doesn't matter as long as you entered the US before then.

You have 90 days to marry whether you got on a plane as soon as you had your visa in hand or waited until the last possible day (do not do this; if you run into travel delays, you'd have to get a new visa).

 

You should file for AOS within the 90 days, because you're technically out of status and deportable between the end of the 90 days and receiving your first notice of action from AOS (there's a relevant recent thread here about someone who had some difficulties due to this) . Marrying close to the end of the 90 days can be a problem for this if it will take you some time to get your marriage certificate (some places you can get it right away, some places it can take a few weeks or longer). However, filing after the 90 days is allowed provided you got married within the 90 days.

 

My recommendation is to legally marry as soon as practical after you enter the US so you can start the AOS process sooner and because you and your spouse usually need to be married for your spouse to add you to his health insurance (presuming he has employer-provided insurance) and some other things.

Agree with others about filing AOS as soon as possible after marriage.

 

BTW, the K1 visa is a one-time, one-way visa that was cancelled by the CBP officer at your US Port of Entry.
