Timeline

Sounds like they want evidence of bona fide marriage. What did you send with the initial petition?

Our CR1 Journey:

 

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!

I would submit more photos from throughout your relationship, not just wedding, boarding passes from trips to visit each other, passport stamps, stuff like that that shows you’ve had an ongoing relationship. They want to see your relationship didn’t just start and end at your wedding

They want the affidavit of people who can witness our marriage. The lawyer here in India want the US format of affidavit. Do anyone know what is US format of Affidavit??

Hello everyone, Yesterday my husband got RFE paper, and they want affidavits of people who can witness our marriage. Has anyone went through this before?? So confused now. One more question... A lawyer here in India wants US format of affidavit so he can do notary. But we don't  know the format of US Affidavit. Do any one know?? Affidavits are the weakest evidence you can send in.  You can't come up with any of the other items? 

 

If you have to use affidavits there are samples on threads on this site.

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

They are questioning your relationship with your spouse, they need more proof. Hard proof is what you need. Show photos of you and your spouse dating, traveling together, of you being at family functions together, chat logs, receipts of remittance, plane tickets, etc. 

Affidavits are not going to cut it when they suspect the marriage isn't real. So you gotta prove it. 

Pay attention to what's highlighted.  A B C D doesn't need to be there, but if you can provide other proof like the ones I mentioned above it will be sufficient. I don't know if your spouse has a 401K retirement fund, but putting you as a beneficiary weighs more than affidavits. 

But be prepared if you can't provide nothing else but affidavits that the petitioner will have to provide a sworn statement on why they can't provide it. 

USCIS stuff is handled by the petitioner. They should be communicating, and handling all RFE's. I don't know why a lawyer in India would be involved, unless your spouse is there with you.

Can you please share the recent Affidavit form of Marriage?? I could not find any. Will appreciate that. Need to send as quick as possible. We already very late.

Hopefully you are going to send other evidence not just the affidavits.

Yes.. other evidence we are sending. Like hotel receipt, chat logs, pics from honeymoon, money sending receipt, he bought a gold ring so that receipt, we went for honeymoon trip so those plane tickets, our pics together from that trip. Hope all that sufficient.

If you want to you can. It's not required.
