Affidavit of Support - Disabled on Social Security. Am I screwed?

glad i came across this thread

my husband is also on disability and isn't working

his benefits do not meet the set poverty guidelines, therefore we are submitting another "I-134 set" from a qualified USC

we are still clueless as to what documents to submit with our I-134, any information about I-134s and disability benefits is appreciated

anyway...

"To file this form, it needs to be sworn to or affirmed by a USCIS Officer at any USCIS Office, by a notary public, or other official authorized to administer oaths for general purposes. If the sponsor is outside the United States, the affidavit must be sworn to or affirmed by a USCIS Officer or Consular Officer at any U.S. Embassy or Consulate.

Once the form is affirmed, it should be mailed to the same USCIS office where the application was filed."

...just making sure here - exactly when should my husband mail the I-134 to CSC? all the while we understood he was to mail the documents directly to me for my visa interview. please enlighten me. thanks.

I'm going through this the first time, just like everyone else, so experience is in short supply.

Our situations are a little different, I have submitted an I-129F fiancee visa application and received a NOA1. Apparantly, that means the CSC got it, now I am waiting for a NOA2, which I believe should be the signal to get the I-134 notarized or signed by USCIS and then send it to the address they request (national service center?). I think they then forward it to the embassy. Same for everyone so far. A copy of the financial information was suggested on the forum also.

As far as what documents to have with you when the I-134 gets notarized/signed by USCIS and then sent in, I just gathered what the forum recommended:

last 3 years of 1040 tax forms with any W2's

transcript of last 3 years tax returns (can get via automated telephone system to IRS)

Last several months statements of any savings, checking accounts, IRA's, etc

A letter from the company that has my IRA stating when I opened the account, how much I have, etc...

last 3 years beginning statement from the SSA stating what SSA disability benefits will be, minus insurance (sent out every December/January)

If you own a home, mortgage statements (how much you owe)

property tax statements as proof of property value (how much equity you have)

and as I stated above, a list of itemized personal property, if you really need to do this to qualify

i need ur help guyz. im a usc and filed the petition of I-130 in california service center last oct 2007, recieved a copy of my noa1 around jan 17th 2008 and now my noa2.. april 2008.... this is my first time to file a petition for my relative and i dont know what is the next step after noa2 recieving by mail... the letter indicates that they already sent the original visa to national visa center? then what next? please help me what going to be the next steps..???

im here in the philippines right now with my husband and planning to say for 6 months.. im just wondering about the affidavit of support bec im not working at the moment, my big concern is my sister is willing to be my co-sponsor but shes on disability due of giving birth last month... shes going to be back at work around june or july... does my affidavit of support be a main reason for my husband petition denial? please help i really need your advice thank you so much in advance ^_^

otherwise that would mean a seriously discriminatory immigration policy toward disabled Americans, but since we're talking about the government, nothing would surprise me.

That is exactly what it is. This immigration law punishes the working poor and disabled by limiting/severely restricting who they can marry. The well-to-do and middle class can marry folks from abroad, while those less fortunate must "stick with their own kind", so to speak.

If I'm not mistaken, one cannot file suit against any part of the Act, although there should be some way of making this into a civil rights issue. Politicians are too afraid to touch the issue of immigration and to get elected they must appear to be stern and merciless, even if this means destroying marriages.

There was a story on CNN of an African-American woman with several kids married to an African man when this law passed. He was deported because his wife didn't make 125% of the federal poverty line. I would have thought that a case like that could have been taken to court (e.g. sue the government), but it didn't work that way.

Anyone on SSI (Supplemental Security Income) will have to find a co-sponsor, otherwise they won't be able to bring their spouse to the US. There are _no_ exceptions that I know of.

Seriously, this is discriminatory, but what can be done about it? It isn't very easy to find a co-sponsor. After all, it is their neck if the immigrant spouse becomes a public charge, so most refuse to be co-sponsors.

The politicians also don't care because they see everything from their own perspective. They are rich and live off our taxes, being the civil servants they are, and don't understand disability or the poverty that often comes along with it.

I hope there will be a bill of rights for the disabled which will allow them to marry people from foreign countries without having to find nearly non-existent co-sponsors.
