Timeline

HEy all

I was wondering if there was an answer to this one...

I(foreign) will be in AZ for about a month this summer and my fiancee and I are going to send off the I-129f package. We were wondering if it was allowed for both the USC and the foreigner to be in USA at that time, or if it would be best for it to be sent of like the day after i leave the country or something like that?

June 20th 2007.....I-129f Sent to CSC!

July 7th 2007....NOA1

November 8th....NOA2

December 8th.....Packet 3 Received (Sent back 10th)

January 8th.....Packet 4 Received

January 16th.....Interview in London

January 20th....Flight to AZ via JFK, received temp EAD

February 29th...Civil Ceremony

March 10th...I485, I765 & I131 sent to Chicago

March 22nd....Received NOA for I485, I131 & I765 (All dated March 18th)

March 24th....Received Biometrics Appointment Letter (dated March 20th)

April 7th...Request for Initial Evidence for I485 (Received in MO on the 10th)

April 9th....Biometrics Appointment

May 30th...EAD Card Production Ordered and AP Approved

June 7th....Wedding!!

June 13th...EAD Card & AP in hand

September 22nd...AOS Interview - APPROVED!

Nov 21st...Card Production Ordered!

Nov 22nd...Welcome to America Letter Received

Nov 29th 2008...Green Card Received!!!

Aug 20th 2010...Mailed I-751 to CSC

Aug 23rd...Check Cashed

It makes absolutely no difference if you're both in the US at the same time when you send off the I-129F. I'm assuming you're going to be there under the Visa Waiver Program, which has nothing to do with your application. As long as you leave the country 1) before the expiry of your VWP and 2) before you have your interview at the Embassy you will be fine.

Good luck and have a great holiday in the States later this summer with your fiancee! :thumbs:

Like was mentioned above, it makes no difference and it may even be easier if you're filling out the forms together since you won't have the lag time between waiting for documents from each other. Just make sure you bring everything you'll need for the I-129F and other forms when you come here on vacation and don't overstay your visit.

03/14/2007 - I-485 + I-765 sent

03/21/2007 - NOA1, Checks cashed

06/01/2007 - EAD card production e-mail received (74 days)

07/27/2007 - EAD RECEIVED (57 days after approval)

11/29/2007 - Infopass appointment - file was sent to a storage facility before it was finished processing.

05/28/2008 - Received AOS Interview notice

07/10/2008 - AOS Interview-APPROVED pending fingerprints

09/22/2008 - GREEN CARD IN HAND!

Removing Conditions

06/04/2010 - Sent I-751

06/07/2010 - NOA1

06/09/2010 - Check cashed

07/22/2010 - Biometrics Appointment

09/08/2010 - Card production e-mail

This is a VFAQ, but for the life of me I can't figure out why.

Time to start trying to figure this out - why do you think that it might not be allowed for the alien to be in the USA when the petition for them is submitted?

It makes no difference.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview
