New rule regarding health insurance

Hi, I just read that the president signed a proclamation barring immigrants who doesn’t have health insurance or the ability to pay for their healthcare.

 

Does anyone here know if this rule will apply to aos applicants?

But, yes, if does apply to those filing AOS in country. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

The new I-944, which will apply to AOS applicants in 9 days, addresses health care insurance........

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I see no reason a spouse would not have health insurance by the time of AOS interview.......

We already submitted the application so we didn’t have to use the new form I-944.

Would it still apply to aos applicants who didn’t file i-944?

My wife has health insurance through employer but the HR department of the company wouldn’t add me without SSN :(

Good question.......I wouldn't be surprised if health care insurance became a point of focus for AOS interviews.........

Thank you!

There is no law which requires a SSN to be added.   I would have a talk with the supervisor.  I know that some carriers will create a temporary number until the spouse gets a SSN......

We did try to talk to a supervisor but they confirmed that it’s their policy... idk what to do 😭

I would explain the dire need for you to be added in light of the implications otherwise......or I would hire an attorney to write them a letter.

Read what IRS says about health care being needed and the following as this came up with the Obama care plan

 

A5: No, it is not necessary for you to contact the IRS if you do not have an SSN or a TIN.  You should advise your coverage provider that you do not have an SSN or TIN and give them the date of birth for each covered individual
