"44 days" ... till what?

Hi,

Im a Canadian Citizen enaged to my wonderful American Fiance. We've applied for our fiance visa through an attorney and we sent all of our information to Vermont in May. Two questions now:

1. We got an e-mail from our attorney last week saying that the "recieved date" was May 21st and he gave us a "Reciept Number"... is this our first NOA or is this something else?

2. Also, on the "Processing Times" page, it says that currently "Filing to I-129 NOA2 in Vermont is 44 days" ... what will happen in 44 days? Will we get a call to set up my interview in Montreal or...?

Sorry if these are really easy questions... I just cant seem to find the answer on this website. Thanks for the help!

44 days is the average time that USCIS takes to adjudicate your petition. You will then receive a NOA2 which states that your petition is approved. Your petition will then be transferred to NVC where they will assign an case number and forward it to the US consulate in Montreal. This takes anything from 10 days to a month. Once Montreal receives the package they will send out a Packet3 to request you to get all the necessary documents mentioned in your packet.

I should mention that Montreal is currently backlogged and is scheduling interviews 5-6 months from receipt of Packet 3.

If you are paying a lawyer to help you with this, he/she should have sat you down and explained the entire process from start to finish. Of course, you should also read the guides here and the information at www.uscis.gov to make sure YOU know what the process is as well - it will serve you well in case your lawyer makes mistakes (and they frequently do).

(p.s. I'm not telling you not to come here for help, I'm just pointing out that you should watch your attorney carefully if he/she has taken money and begun processing the application on you behalf without fully informing you of the process. Also, you should know that a lot of our VJ shorthand and abbreviations aren't used by the rest of the world. Some things are, but others are not. Don't get confused between what your lawyer tells you and what people here tell you. Tomorrow, however, you should call and ask your attorney to break down the entire process for you - see what information you get.)

The guides do tell you everything, but no you dont get a phone call. You do get a couple of letters though.

1. Thats your first NOA, it looks like everything is being sent to your lawyer.

2. Assuming you dont get an RFE, in about 44 days you will get another Notice of Action. This copy you need to keep. It will have your alien number on it. At that point its forwared to the NVC, an new case number is assigned to it. Then its forwarded to the embassy or consulate. The consulate will then contact either by mail, or email with packet 3 information. Each consulate does things its own way. You will recieve instructions or a checklist with packet 3.

Got it. Thanks. I've never personally met or talked to our attorney, he is actually from CA and my fiance has been the one dealing with him. We have a couple of other friends who were in the same situation as us and used this same attorney so we got good recomendation to use him.

In that case, you need to make sure your fiance is keeping you up to date! :) (you don't want to end up in an argument because information you get here conflicts with information from your fiance's attorney.)
