New Healthcare Requirements for US Immigrants

I'm still waiting for USCIS approval. My petition is at Potomac (August 2019 filer) so I'm hoping that he will have his visa in hand sometime mid to late 2020. 

Should I wait till embassy stage to buy him visitor's health insurance policy ?

I also will add my husband to my policy when/if he gets here. I talked to our central office people, who gave me a copy of our rules that say that spouses/children can be added due to a life-changing event. Getting a visa to come here is considered a life-changing event, so I will have evidence that he will have health insurance. Can you do that?

It was easy, not an issue. 

 

Could be that such things are overseen on a state-level, thereby creating inconsistencies across the US.

Were you able to get it before your spouse got to the country?

 

This is what my employer's benefits department told me, "You cannot add her if she is not in the country.  When she arrives in the USA, we will need proof of entry and you can add her to your coverage at that time.  Just let us know then"

Leostar, as NVC sites says: " A nationwide temporary restraining order has been issued". You can read it here: https://travel.state.gov/content/travel/en/us-visas/immigrate/Presidential-Proclamation-on-Health-Care.html.

 

And besides, your parents interview occurs during the injunction period, so you need not worry or stress yourself about health insurance for your parents (at least for their interview).

 

In addition, even if there were no restraining order or injunction, the provision has several exceptions and IR5 immigrant visa category was one of the exceptions. NVC has removed that online entry in lieu of the link I've provided above, but overall, you will not now, or at anytime in the future have to worry about this proclamation going forward.

I met with a specialist to go over my healthcare options for 2020.  We are doing open enrollment at my work.  Some great stuff came out of the meeting.  Some items i'll be bringing with me to the interview even if there is or isn't a requirement in Q1 2020.  I put my life insurance policy in my fiance's name and listed her as "friend" since she's not my wife yet.  I have documents from my healthcare provider which shows that lawful marriage is an event which would open enrollment back up and allow her to be covered really quickly.  I'll be bringing my life insurance policy, short term disability policy, long term disability policy, and proof that she will be covered by my healthcare to the interview.  Needed or not it's peace of mind for me.   I'm assuming they like to see that in case of something tragic, she'll be OK financially.

 :) :) thank you!  We are waiting for the NVC email right now.  Every day it moves from a dream to a reality.  Having that meeting with the benefits specialist gave me goosebumps.  Talking about her being HERE in 2020!!! OMG!!! :)

In Our state you can get onto your employer insurance as domestic partner to get them on your insurance as quickly as possible. Letter from SS office that you applied for SSN will meet SSN requirement for application. Employer ask for notarized documents to support that you live together as domestic partners. After you get married, we submit the insurance paperwork as spouse.
