But tourist plans and "catastrophic" pans are explicitly in according to the proclamation. Are they ACA compliant?  They may get you in the country but represent a huge risk and a poor long-term solution.

 

I think that baring a successful legal challenge, the interviewers have an impossible job.

Seems more logical to just show what your actual plan is, be added to a spouse, buy your own. Why mess around with pseudo travel policies.

Can anyone following this who has an interview in Juarez the next few weeks please let us know what the interviewer required to prove health insurance would be obtained?? This is so damn frustrating...

No they aren't compliant. Which begs the question, if the whole thing is supposed to be about self sufficiency and not being a potential burden, why even mention those as an option? 😉

It doesn't even specify insurance as the only solution.

how does one measure that?

My HR manager wants me to get a copy of the rule that states they need to be insured within 30 days. Does anyone happen to know where I can find that? Thank you.

Goodness, the HR doesn't even know? This shouldn't be your responsibility...  Here's a little publication overview from the DoL https://www.dol.gov/sites/dolgov/files/EBSA/about-ebsa/our-activities/resource-center/publications/life-changes-require-health-choices.pdf

And the exhcange itself: https://www.healthcare.gov/glossary/special-enrollment-period/ SLEQ's for the exchange are 60 days, but job based plans must be 30 days. Generally every single insurer will have language to this effect, surely your HR should know how their own plans work?

Well I can only surmise that if you were a millionaire, and produced evidence to show that your bank account was loaded with sufficient cash to pay outright any foreseeable medical costs for the immigrant's care? But yes, sarcasm aside, it is difficult to quantify. Some people do have insurance but still manage to go bankrupt due to unforeseen medical diagnosis.

A change in status (visa) is grounds for a special enrollment period for any health insurance company.

PP 9945 does not suspend or limit the entry of applicants if they do not have coverage, but possess financial resources to pay for reasonably foreseeable medical expenses. Reasonably foreseeable medical expenses are those expenses related to existing medical conditions, relating to health issues existing at the time of visa adjudication.

(While it is advisable that one have insurance in the US, if you have no chronic illness, couldn't you just claim that you can afford your medicine and check-up and slip through?)
