I think this issue , the yet to be implemented, requirement that interviewees be able to to show health coverage or equivalent and the changes to "public charge" policy ( On hold as of 10/15) have been conflated in people's mind. 

 

The subject of this thread is not on hold by any judicial action because State has not created the law to match the Oct 3rd proclamation.  Folks are concerned because the White House proclamation says it will go into effect starting Nov 3, which is practically impossible.

The answer to that question is two fold, it is doubtful the law will be implemented by then and if it was, no one has that guidance to that detail.  If you can get insurance within thirty days you will be good according to the proclamation.

Yup. Seems @Riadhora was confused since this thread IS relevant to their IR-1/CR-1 case: https://www.visajourney.com/timeline/profile.php?id=328757 Assuming their "lawyer" knew their case was IR-1/CR-1, I'd question that "lawyer's" competence.

I cannot blame folks to being confused and worried. The hodgepodge of poorly thought out proclamations is crazy making.

I saw on the state gov that she can be rejected for not having any. It's just a matter of timing because I can't get the insurance quick enough for the interview. So Im just wondering what are my options if the law is uphold and she needs to provide health insurance.

If the interview was held today, she could not be rejected based on health insurance.

When is your interview? 

Do you have a plan for health care for her within 30 days?

It's the 7th of November . Im on my mom's insurance because Im 23. I originally planned when she got here I would have  take the one from my job. So that's the reason why I didn't take it out sooner and my employers say they sent the insurance package to all employees  and I should receive it by now and 1st of November. But I learned about this health insurance police last week and Im worry she will get rejected because I can't get her insurance by the time of her interview.

If you sign onto the employer-based insurance during open enrollment, it will take effect on 11/1/19, correct? If you sign up, I don't see why you can't show that she will be eligible to be added to your insurance.  Every plan has printable info about the policy for adding family members.

To express something from my state to her country takes around 7-8days . each time I express something that's the timeline she receive something. So if I sent it on the first then Im pretty sure she won't see that document until after the the interview

Email should work, send a PDF document.

Why not just scan and email to her, and she can print them out?  Those types of documents need not be originals.

That's my plan. I talk to HR because I saw that open enrollment started at the 25th of this month. And they told me to wait for the package(health insurance)  to be sent to my address and then I can sign up for it. So I'm hoping I receive it in the mail soon, so that I can sign for it and then email my wife with the confirmation so that she can print it out.
